The permit shall expire July 28, 2025. Pursuant to 130A-294(a2) and 15A NCAC 13B .0206(b), the Permit to Operate is subject to a limited review by July 28, 2020. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0203(d). General Permit Condition 16(a). The facility has made noticeable improvements on cleaning the floor of the transfer station building. Metal sheeting has also been placed on the walls of the building to keep waste from falling behind push walls. This violation is considered resolved. 2) 15A NCAC 13B .0203(d). Waste was not observed on the ground outside of transfer station building and transfer trailer loading bay. The facility has implemented a new procedure for covering outgoing trailers from the trailer loading bay. This violation is considered resolved. 3) 15A NCAC 13B .0203(d). General Permit Condition Number 7. An individual trained and certified in facility operations was present during the inspection. This violation is considered resolved. OBSERVED VIOLATIONS: 1) 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Section 2.6 Waste Receiving and Inspection of the approved Operations Manual (DOC ID 22254) dated September 18, 2014 states in part: “At least one vehicle per will be randomly selected by inspection personnel.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 During the inspection, review of the waste screening records indicated that random load inspections were not being conducted during July 18, 2019 thru September 4, 2019. According to Mr. Cloninger, the lack of waste screenings was due to change in facility personnel. To achieve compliance with 15A NCAC 13B .0203(d), God Bless the USA, Inc., a wholly owned subsidiary of Waste Connections, Inc., must immediately implement waste screening procedures as outlined in the approved Operations Manual. ADDITIONAL COMMENTS 1. The facility is a permitted solid waste transfer facility. 2. The facility is permitted to receive solid waste generated within Union, Mecklenburg, Cabarrus, Anson and Stanly Counties in North Carolina and Lancaster, Chesterfield and York Counties in South Carolina. 3. All waste received must be transported for disposal to the BFI-Charlotte Motor Speedway Landfill V (Permit No. 1304-MSWLF-1992) or the Chambers Development Landfill (Permit No. 0403-MSWLF-2010). 4. Proper signage was observed at the entrance of the facility. 5. Access to the site is secured by a gate and fencing surrounding the facility. Operations Inspection of the Transfer Facility: 6. Observed operations of the transfer facility. 7. No unacceptable waste streams were observed. 8. The floor of the building is sloped to allow leachate from the tipping floor to drain into the trailer loading bay thru scupper holes in the lift-over wall. Sumps located in the trailer loading bay collect the leachate which is gravity fed to an oil water separator. The leachate discharges directly into the City of Monroe sewer system. 9. The facility receives commingled recyclable materials from GBUSA/Waste Connection routes only. The recyclables are off-loaded on the left side of the transfer station building tipping floor. Throughout the day, recyclables are loaded into transfer trailers and hauled to the ReCommunity Recycling Center in Charlotte, NC. When the facility permit is renewed, modified or reviewed, the recyclable materials transfer operation should be included in the operations plan. 10. Windblown waste was well controlled. 11. Hauling of the waste is conducted by Atomic Transport, LLC. Two transfer trailers were observed to be leaking during the inspection resulting in leachate depositing on the ground directly beneath the trailers. Mr. Cloninger immediately notified Atomic Transport and the trailers were hauled to the landfill and will be repaired before being placed back into service. Mr. Cloninger was advised to dig up the gravel base that was impacted by the leachate and dispose of it in the transfer station. View of leachate on ground under trailer. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
