Resolved: 15A NCAC 13B .1626(2)(a) cited for failure to cover all waste with six inches of earthen material or approved ADC at the conclusion of each operating day. A follow-up inspection to the June 6, 2019 inspection was performed on June 13, 2019. Waste was noted as still exposed at the cell 2/cell 3 seam during the June 13, 2019 inspection. On August 29, 2019 inspection all waste has been adequately covered. This inspection was conducted during normal business hours and the working face was uncovered per standard operational procedures. B. Resolved: 15A NCAC 13B .1626(11)(c) states, in part: " At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator." The County of Randolph, N.C. and Waste Management of Carolinas, Inc. has properly disposed of all windblown litter at the facility and by the conclusion of the previous day of operations. C. Resolved: 15A North Carolina Administrative Code 13B .1626(8)(d) states in part: “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” Leachate outbreaks noted on April 18, 2019 and May 16, 2019 have been contained and no further outbreaks have been reported. The Solid Waste Section requested additional sampling on May 31, 2019. The Solid Waste Section Hydrogeologist has reviewed the results submitted for the chrome speciation analysis of soil samples collected in the area of the two leachate releases at the landfill and have determined that the residual concentrations of hexavalent chromium in soils meet the PSRGs for the protection of groundwater. As a result, no further action is required of soils remaining in the vicinity of these two leachate releases. OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS On June13, 2019, Chuck Kirchner met with Don Misenheimer from Waste Management to conduct a follow-up partial inspection of the Great Oak Landfill on Old Cedar Falls Road in Randleman, Randolph County. In addition, another follow-up inspection and cell 3A pre-operational meeting was conducted on August 29, 2019. This inspection was between Chuck Kirchner, Christine Ritter and Ming Tai-Chow with the Solid Waste Section and Mike McFeeley and Susan Harrison with Waste Management. In addition, Jared Timmons with SCS Engineers was present for this inspection. This inspection was a compliance inspection for the April 10, 2019 Notice of Violation. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Great Oak Landfill is a municipal solid waste (MSW) landfill owned by Randolph County and operated by Waste Management of Carolinas, Inc. 2. Follow-up inspections have been performed on April 23, 2019, May 16, 2019, June 6, 2019, June 13, 2019 and August 29, 2019 to follow up on the April 10, 2019 Notice of Violation and the Waste Management response letter dated April 19, 2019. 3. All waste appears to have met cover requirements and no windblown waste was observed during this inspection. The facility is in compliance with the corrective actions required under the April 10, 2019 Notice of Violation at this time. 4. Phase 3A liner has been installed per the Permit to Construct dated February 16, 2015. 5. Leachate was observed flowing from Cell 2 area onto the Cell 3 liner. This leachate is currently being captured on the Cell 3 liner and is being pumped over to the leachate collection system. Work is currently underway to install leachate pump in Cell 3 leachate collection system. Once the pump is installed Cell 3 will be an active part of the leachate collection system. 6. Continue to remove accumulated sediment from the main erosion and sediment control basin below Cell 2 and Cell 3 area. 7. Working face operations in Cell 2 area during inspection. 8. The operations plan states that the facility may use reusable tarps, auto-shredder fluff, and petroleum contaminated soil as ADC. 9. It was previously noted that the facility uses tarps Monday through Friday and covers with soil on Saturday. Continue to ensure that all windblown waste is to be returned to the working face or adequately covered at the conclusion of operations each day.
