Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on August 21, 2019. 2. The permit to operate Phase 3, Cell 1 was issued on May 31, 2018; however, filling has not begun in the new cell. Operations Inspection of MSWLF Unit (5703-MSWLF-1992) 3. Minimal windblown litter was observed outside the landfill cell; however, litter which appeared to have been tracked by equipment was noted on the northeastern end of Phase 2 Cell 1. Adequate soil cover appeared to have been placed in these areas. The working face had recently been relocated farther to the south in the cell and the movement of equipment appears to have resulted in exposed waste. The facility had stockpiles of soil in the area and staff stated that additional soil would be placed over the area. Additional soil cover must be placed in the areas where waste has become exposed. NCAC 13B .1626(2)(a) states in part, "the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging." 4. The working face was small and compact. A scrap tire was observed in a recently dumped load. Facility staff also saw the tire and removed it from the working face. Please continue to remove banned material from the working face and dispose of them in the proper manner. Operations Inspection of the Yard Waste Treatment and Processing Area 5. The facility accepts untreated, unpainted pallets, wood, leaves and land clearing debris. 6. The material is ground and mixed with soil for use as an approved alternative daily cover for the landfill. No ground material is distributed to the public. 7. The facility has a roll off container to dispose of any unapproved material that may be mixed into incoming loads. A black plastic bag and plastic bottle were noted in recently dumped load. Please continue to remove unapproved material from incoming loads. Operations Inspection of the Recovery Center 8. All non-commercial loads (excluding construction and demolition debris) are directed to the recovery center which is located to the east of the landfill. 9. The incoming waste is dumped onto the tipping floor, then loaded over a wall into an open top trailer and transported to the working face. 10. No unapproved material was observed on the tipping floor at the time of inspection. 11. The floor drains were observed to be clean and appeared to be working properly.
