Vaughan 4752 Highway 301 Halifax, NC 27839 PARTICIPANTS: Ben Barnes, NCDENR, Solid Waste Shawn McKee, NCDENR, Solid Waste Mary Whaley, NCDENR, Solid Waste STATUS OF PERMIT: No permit is required PURPOSE OF SITE VISIT: Comprehensive inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS NONE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS: HISTORY 1. The coal ash was deposited at this site to reclaim a licensed soil mining site and restore it to pasture land. 2. The coal ash would be coming from Westmoreland Partners, Roanoke Valley Energy Plant, Weldon, NC. The contact for the power plant is Glenn Outland. 3. URS Corporation, 1600 Perimeter Park Drive- Suite 400, Morrisville, NC 27560, telephone: 919-461-1100, is the engineering firm handling the construction of the site. 4. On February 4, 2008, the Solid Waste Section issued a letter stating that they had received the documentation necessary for the notification of the site and that they could start construction. 5. It was estimated that the 6 acre site would be completed by September, 2008 and that the site would have 64,000 cubic yards of coal ash deposited. 6. URS Corp. stated that the deed was recorded on May 11, 2009. INSPECTION COMMENTS The site appears to have a good ground cover of grasses, lespedeza and pines established. It is recommended that future inspections be done in January or February after the ground cover has died back, to better access the site. There appeared to be exposed coal ash on the access road going from Hwy 301 to the actual structural fill site. All coal ash is to be covered with 18 inches of soil, with the top 6 inches being able to have a ground cover established.
