PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection without records review. STATUS OF PAST NOTED VIOLATIONS: This Facility has no past violations. OBSERVED VIOLATIONS: 1) 15A NCAC 13B .0104 (f) states “All solid waste shall be stored in such a manner as to prevent the creation of a nuisance, insanitary conditions, or a potential public health hazard.” 2) 15A NCAC 13B .0402 (1) states “Operational plans shall be approved and followed as specified for the facility.” 3) 15A NCAC 13B .0402 (7) states “Appropriate method shall be provided to confine material subject to be blown by the wind within the area. At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator.” Please see the ADDITIONAL COMMENTS section below for details concerning the violations listed above. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 6712T_INSP_20190625 Page 2 of 3 ADDITIONAL COMMENTS: 1) This is a Construction & Demolition (C&D) Waste Transfer Facility and a Temporary Disaster Debris Staging Site (TDDSS) for disaster generated demolition material. 2) Proper signage has been posted at the Facility entrance stating the Facility name and contact information. 3) All C&D waste received by this Facility is transferred to the Maysville C&D Recycling & Recovery Facility, permit #52-02 in Maysville, NC for recycling. 4) This site is secured by a locked gate at the Facility entrance. 5) The gate was open upon my arrival and attendants were on-site during this Facility Compliance Inspection. 6) No off-site erosion was observed during this Facility Compliance Inspection. 7) The Facility access roads are of all-weather construction and appear well-maintained at this time. 8) Signage is posted adjacent to the scale entrance listed accepted and excluded waste types. 9) Access around the Facility overall is generally stable and no areas of erosion were noted during this Facility Compliance Inspection. However, sparse cover inadequate to prevent erosion was observed on the sides of the transfer station access ramp. *Within thirty days of receipt of this Facility Compliance Inspection Report, please seed and mulch these areas to establish a groundcover suitable to prevent erosion. 10) Only one transfer trailer was observed on-site during this Facility Compliance Inspection. *Please ensure that an adequate number of trailers is maintained onsite for the volume of waste managed by this Facility. 11) All transfer activities are currently being conducted through the TDDSS. *All non-disaster related waste should be managed through the permitted transfer facility and maintained separate from disaster generated debris. 12) *Within thirty days of receipt of this Facility Compliance Inspection Report, please properly close and restore the TDDSS to pre-use conditions. 13) *All incoming waste should be placed directly into transfer trailers for transport to the recycling facility in Maysville. 14) *Non disaster-related waste may only be stored on site during the day in vehicles or leak resistant containers. Non disaster-related waste must not be left on site after operating hours. 15) The waste types were reviewed, no unpermitted materials were observed during this Facility Compliance Inspection. 16) *Corrective measures are required as a result of this Facility Compliance Inspection. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
