STATUS OF PERMIT: Permit To Operate (PTO) issued October 2, 2017 Life-Of-Site (LOS) Permit PTO expiration date October 3, 2023 - consistent with Franchise Agreement term PURPOSE OF SITE VISIT: Partial Inspection – NOV Compliance Inspection OBSERVED VIOLATIONS: No new violations observed. STATUS OF PAST NOTED VIOLATIONS: 1. Resolved: 15A NCAC 13B .0542(g)(3) cited for failure to collect windblown litter at the conclusion of each operating day. Resolved: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 4117, Attachment 1, General Permit Conditions/Information, Part I & III and General Facility Permit Condition 6 & 7 cover in part Sedimentation and Erosion Control rules. A-1 Sandrock, Inc. received a S&EC plan approval from Guilford County on June 4, 2019. A copy of the approval letter from Guilford County was provided during this inspection. 3. Resolved: 15A NCAC 13B .0542(k)(2) states: “Adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent excessive on-site erosion of the C&DLF facility or unit.” A-1 Sandrock, Inc. has installed adequate temporary sediment control measures and has seeded and mulched many bare areas in an attempt to establish grass cover sufficient to prevent excessive on-site erosion. Good grass cover was observed in many areas to include the excess soil stockpile on the south side of site. One area of slope across the access road from LG-5 was being repaired and stabilized during this inspection. No other erosion was noted during this inspection. Shown above are the area being repaired during this inspection and the stabilized soil stockpile on south side of site. ADDITIONAL COMMENTS On June 5, 2019, Chuck Kirchner met with Jason Tarkenton to conduct a NOV compliance inspection of the A-1 Sandrock, Inc. C&D Landfill on Bishop Road in Greensboro, Guilford County. 1. The facility is a construction and demolition debris (C&D) landfill with a C&D treatment and processing (T&P) operation. 2. This inspection was a compliance inspection of the February 20, 2019 Notice of Violation. 3. The facility is in operation Monday through Friday 7:00 am – 5:00 pm and Saturday as needed. 4. The facility permit approves the operation of C&D landfill Phases 1 and 2 and the C&D T&P [sorting and recycling] operation. Plans for Phase 3A are currently under review. Please ensure no waste is placed in Phase 3A area until that area is approved. 5. The facility is accepting C&D in the south side of Phase 1, Cell1A. 6. Since last inspection three additional personnel have been hired on site. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 7. 15A NCAC 13B .0542(g)(3) states in part: “At the conclusion of each operating day, all windblown material resulting from the operation must be collected and disposed of by the owner and operator.” Some litter was observed in proximity to the working face. Ensure any windblown litter waste is returned to the working face at the conclusion of each working day. Litter material observed to the west of the working face. 8. 15A NCAC 13B .0542(f)(1) states in part: “The owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly.” The working face observed during the June 5, 2019 inspection appeared close to exceeding one-half acre. Ensure that the working face and all wastes are covered as required. Working face observed on June 5, 2019. 9. Keep the uncovered section of the working face as small as operationally feasible. 10. The permitted waste disposal area needs to be designated by edge-of-waste markers. Some markers have been removed or damaged by equipment operating near markers. Please replace missing or damaged markers. 11. The facility is currently placing waste in the south side of Cell 1A, and currently has Phase 3A under review and awaiting permitting approval. Landfill Gas Wells (LFG) LG-2, LG-3, LG-5, LG-6, LG-10, LG-11 & LG-12 were observed during this inspection. 13. Ground Water Monitoring Wells (MW) MW-1, MW-2, MW-3, MW-4 & MW-6 were observed during this inspection. 14. Ensure a readily accessible unobstructed path to each groundwater monitoring well and landfill gas monitoring well location is maintained as discussed in the field. 15. Ensure all wells are properly labeled and are locked. In 2017 the Section sent a memorandum to facilities stating that for consistency going forward monitoring wells would be inspected to include 15A NCAC 2C requirements. Landfill gas wells are an open path to groundwater and thus a potential conduit for contamination. LG-11 shown on left with no lock and MW-1 shown on right has a label that has become detached. 16. Any eroded rills on the landfill cap shall be repaired accordingly. 17. Continue to seed and mulch all disturbed areas regularly until vigorous grass cover germinates sufficient to restrain erosion. Small area of slope was being repaired and stabilized during this inspection. 18. The Pinecroft Sedgefield Fire District can be contacted to address an emergency at the facility. 19. The facility has all-weather access roads. 20. The facility is secured by a locked gate. 21. The facility has a proper sign. 22. The PTO expiration date is October 3, 2023, consistent with the Franchise Agreement term. 23. The PTO expiration can be adjusted when a new Franchise Agreement is obtained. 24.
