This permit expired on June 3, 2018. A Permit Renewal Application was received by the Solid Waste Section on October 4, 2018 and is currently under review. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .0402(7) states: “Appropriate method shall be provided to confine material subject to be blown by the wind within the area. At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator.” 15 North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” x Operating Condition #8(e)(ii) of the approved Permit to Operate states: “Windblown materials must be collected by the end of the day and no windblown material may be allowed to leave the facility boundary.” During an inspection of the closed MSWLF (0302-MSWLF-1981) on April 11, 2019, a large amount of windblown waste was observed along eastern perimeter of the landfill. Waste had been deposited along the edge of the landfill and into the woods. The volume of windblown waste indicated it had accumulated over a period of multiple days. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Alleghany County was found in violation of 15A NCAC 13B .0402(7) and .0203(d) in that windblown waste had not been collected at the conclusion of each day of operation. To achieve compliance, Alleghany County was required to pick up all windblown waste and return it to the transfer station for proper disposal within 10-days of receipt of the previous inspection report. Inspection of the facility on April 25, 2019 found that all windblown waste had been picked up and removed from the surface of the closed landfill and the woods adjacent to the landfill. Windblown waste at the facility was well controlled. Therefore, the above violations are considered resolved. Thank you for your cooperation in this matter. OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. This was a partial inspection to evaluate Alleghany County’s efforts to comply with the violations documented on the previous inspection report issued on April 18, 2019. Please refer to “Status of Past Noted Violations” for comments. Operations Inspection of the Transfer Station: 2. No unacceptable waste streams were observed. 3. During the previous inspection, waste was observed within the stormwater junction box located adjacent to the entrance to the transfer trailer loading bay. It was requested that all waste be removed from the stormwater junction box. It was also recommended that steps be taken to prevent waste from depositing into the junction box which could lead to leachate concerns. x Inspection of the facility on April 25, 2019 found that majority of waste had been removed from the junction box with only a small amount remaining. A steel grate had also been placed over the junction box. Please ensure that all remaining was is removed from the device. Also, continue to monitor the device to ensure that the steel grate is adequate to keep waste from depositing into the junction box. 4. During the previous inspection, dark staining was observed on a gravel area near the scalehouse where three blue rollout waste containers were staged for collection of used oil filters. One container was found to be full of water with multiple oil filters floating within the container. It appeared that oil laden water from the waste container had deposited onto the ground. This condition was referred to Carin Kromm, Supervisor, Underground Storage Tank Section at the Winston-Salem Regional Office. x Inspection of the facility on April 25, 2019 found that the waste containers had been removed. All oil stained gravel had also been removed and replaced with fresh gravel. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
