PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B .0505(5)(b) states: "Surface water shall not be impounded over or in waste." During the previous inspection on January 30, 2019, areas on top of the landfill were observed where settlement had taken place and where water had ponded in depressions that resulted from this settlement. On April 18, 2019, Ms. Tinsley notified the Solid Waste Section (SWS) that the facility grounds maintenance crew had completed repairs. During this inspection, the areas in the landfill cap that had subsided were found to have been repaired, regraded and seeded so that the depressions observed previously were no longer evident and new grass was becoming established in these areas. Therefore, this violation is considered to be resolved. OBSERVED VIOLATIONS: None. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: I. On January 10, 2019, Ms. Tinsley provided proof of the change in ownership of the facility from PPG Industries Fiber Glass Products, Inc. to Nippon Electric Glass, as requested. 2. The small areas along the northern fence line that had been bare, with a hardened clay surface and no vegetative cover, were found to have been repaired and seeded, with new grass becoming established. 3. The two small areas near the central portion of the landfill, where ponding water had been previously observed, were also found to have been repaired, and no evidence of subsidence was visible.
