Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Lincoln County. 3. The facility accepted an average 117 tons per day. (Jan. 2019-Mar. 2019) 4. The C&D Landfill accepted an average of 24 tons per day. (Jan. 2019-Mar. 2019) Operations Inspection of the MSW Landfill Unit: 5. The facility is currently working in Phase 3 and Phase 4. 6. No unacceptable waste streams were observed in the MSWLF. 7. Edge of waste markers were observed. 8. All access roads maintained in good condition. 9. Working face was small and compact. 10. The facility utilizes soil and spray -applied Mortar Coating (SMC) for daily cover. 11. Slight amount of windblown was observed along the northern roadway to the working face. Material was captured by wind fence. Waste observed appeared to be no more than from daily activities. Windblown waste was being collected during the inspection. C&D Landfill Unit 12. Edge of waste markers were observed. 13. All access roads maintained in good condition. 14. Working face less than '/z acre in size. 15. The facility utilizes soil for cover which is applied weekly. 16. Windblown waste was well managed. White Goods & Scrap Metal Collection Area 17. Area is well maintained. 18. White goods and scrap metals are staged on a concrete pad with push -walls. 19. White goods were well organized and stored in an upright position. 20. CFC's are removed from all white goods by facility staff. 21. Scrap metal is collected by Southern Metals for recycling. Scrap Tires 22. Scrap tires are collected and stored in US Tire semi -trailers. 23. Area is organized and well maintained. Electronics Recycling 24. All electronics are collected and taken for recycling by eCycleSecure of Charlotte, NC. 25. Electronics are staged and shipped from the white goods concrete pad. Used Oil Collection 26. Area is clean and organized in a fenced area located on the NW side of the office building. Citizens are escorted to the area for disposal. 27. Used oil is utilized for heating the shop at the facility. Lincoln County owns the tub grinder used to process the yard waste. Currently it is down for maintenance but expected to be running in two weeks. 29. Area was well organized and maintained. 30. Good access around windrows and finished pile for access by firefighter equipment. 31. After composting (131°F for at least three days) the mulch is either distributed for use at Lincoln County facilities for beautification or given away to Lincoln County residents at no cost. Records Review 32. A copy of the current permit and operations plan are maintained in the landfill office. 33. 15t Semi-annual groundwater monitoring dated April 2018 and 2,d Semi-annual groundwater monitoring dated October 2018 were reviewed. Leachate monitoring is performed semi-annually with their groundwater monitoring. 34. The landfill gas monitoring plan consists of gas monitoring wells MMW-1,2,3,4,5,6,7, and 8, along with the landfill shop, scale house. 35. Landfill gas monitoring is performed by facility staff monthly and results are submitted to the Section quarterly. The most recent monitoring event occurred on March 20, 2019. 36. Random inspection reports were reviewed. Facility staff perform one (1) random inspection each day at MSW and CDLF. Reports provided good documentation of observed unacceptable waste streams and final disposition of these wastes. Records reviewed were from January 1, 2019 — April 22, 2019. 37. The facility has two 325,000 gallon, above ground storage tanks. 38. Leachate is gravity fed to the lift station which pumps the leachate up to the leachate tanks. 39. Leachate is pumped and hauled by landfill staff to the City of Lincolnton WWTP. 40. Certified Operators are as followed: David M.
