STATUS OF PERMIT:
A Permit to Operate the Alleghany County Transfer Station was issued to Alleghany County on March 15, 2013. This
permit expired on June 3, 2018. A Permit Renewal Application was received by the Solid Waste Section on October 4,
2018 and is currently under review.

PURPOSE OF SITE VISIT:
Partial Inspection

STATUS OF PAST NOTED VIOLATIONS:

OBSERVED VIOLATIONS:
15A North Carolina Administrative Code 13B .0402(7) states: “Appropriate method shall be provided to confine
material subject to be blown by the wind within the area. At the conclusion of each day of operation, all windblown
material resulting from the operation shall be collected and returned to the area by the owner or operator.”

15 North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a permitted facility, the
permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit.”
x Operating Condition #8(e)(ii) of the approved Permit to Operate states: “Windblown materials must be
collected by the end of the day and no windblown material may be allowed to leave the facility boundary.”

During an inspection of the closed MSWLF (0302-MSWLF-1981), a large amount of windblown waste was observed
along eastern perimeter of the landfill. Waste has been deposited along the edge of the landfill and into the woods. The
volume of windblown waste indicated it had accumulated over a period of multiple days. Alleghany County is in
violation of 15A NCAC 13B .0402(7) and .0203(d) in that windblown waste had not been collected at the conclusion of
each day of operation.

To achieve compliance, within 10-days of receipt of this inspection report, all windblown waste must be picked up
and returned to the transfer station for proper disposal.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS

1. This was a partial inspection performed to address the issue of windblown waste deposited along the eastern
perimeter of the closed MSWLF (0302-MSWLF-1981). Please see “Observed Violations” for comments.

Operations Inspection of the Transfer Station:

2. No unacceptable waste streams were observed.
3. The floor of the transfer trailer bay was free of waste at the time of inspection.
4. During the inspection, waste was observed within the stormwater junction box located adjacent to the entrance to
the transfer trailer loading bay. Please note, any water that comes in contact with waste is considered leachate. All
waste must be removed from the stormwater junction box. Steps should be taken to prevent waste from
depositing into the junction box which could lead to leachate concerns.
5. During the inspection, dark staining was observed on a gravel area near the scalehouse where three blue rollout
waste containers were staged for collection of used oil filters. One container was found to be full of water with
multiple oil filters floating within the container. It appeared that oil laden water from the waste container had
deposited onto the ground. This condition has been referred to Karin Kromm, Supervisor, Underground Storage
Tank Section at the Winston-Salem Regional Office.
