STATUS OF PERMIT: Permit To Operate (PTO) issued October 2, 2017 Life-Of-Site (LOS) Permit PTO expiration date October 3, 2023 - consistent with Franchise Agreement term PURPOSE OF SITE VISIT: Partial Inspection – NOV Compliance Inspection OBSERVED VIOLATIONS: No new violations observed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 STATUS OF PAST NOTED VIOLATIONS: 1. Resolved: 15A NCAC 13B .0542(f)(1) cited for failure to cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Areas of exposed waste on the east side of Cell 3A, and at toe of the slope approximately where Cell 2A and Cell 2B meet, have been adequately covered. Areas where waste was noted as uncovered during the 2/5/19 inspection report were observed covered on 4/4/19. 2. Resolved: 15A NCAC 13B .0542(g)(2) cited for failure to compact solid waste as densely as practical into cells. The working face of the landfill is now over Cell 1A. The slope is closer to 3H:1V and adequate compaction has been achieved. It appears toe of slope of working face may be encroaching into phase 3 area. Ensure all waste is inside approved cells and covered at least weekly. Working face has achieved proper compaction. Corrective measures in progress: 15A NCAC 13B .0542(g)(3) cited for failure to collect windblown litter at the conclusion of each operating day. Most of the windblown litter had been collected at the site, however, some additional litter remained in ditches throughout the facility. 4. Corrective measures in progress: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 4117, Attachment 1, General Permit Conditions/Information, Part I & III and General Facility Permit Condition 6 & 7 cover in part Sedimentation and Erosion Control rules. A-1 Sandrock, Inc. has submitted an S&EC plan to Guilford County for review. Adequate temporary sediment control measures have been installed to prevent sediment from leaving site until S&EC plan is approved by Guilford County and approved measures can be installed. A-1 Sandrock, Inc. has also seeded and mulched many disturbed areas. Temporary sediment trap installed below stockpile on Stockpile has been re-graded and seeded and mulched. southeast side of site. 5. Resolved: 15A NCAC 13B .0542(k)(1) states: “Adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent sediment from leaving the C&DLF facility.” A-1 Sandrock, Inc. has installed adequate temporary sediment control measures sufficient to prevent sediment loss off site. In addition, according to facility staff an Erosion and Sedimentation Control plan has been submitted to Guilford County and is currently under review. 6. Corrective measures in progress: 15A NCAC 13B .0542(k)(2) states: “Adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent excessive on-site erosion of the C&DLF facility or unit.” A-1 Sandrock, Inc. has installed adequate temporary sediment control measures and has seeded and mulched many bare areas in an attempt to establish grass cover sufficient to prevent excessive on-site erosion. During this inspection it was noted that several sediment rills have been repaired. There are some rills on the north and west side still to be repaired. In addition, sediment load in the interior ditch line has been removed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 7. Resolved: 15A NCAC 13B .0542(l)(4) states: “Leachate must be contained on-site or treated prior to discharge.” A-1 Sandrock, Inc. has submitted a soil sampling plan and is currently working with Ms. Ritter on sampling and analytical requirements for the facility. Additional measures and/or information may be required pending the results of the soil sampling submitted to the Solid Waste Section on 4/11/2019. ADDITIONAL COMMENTS On April 4, 2019, Chuck Kirchner and Deb Aja met with Jason Tarkenton to conduct a NOV compliance inspection of the A-1 Sandrock, Inc. C&D Landfill on Bishop Road in Greensboro, Guilford County. 1. The facility is a construction and demolition debris (C&D) landfill with a C&D treatment and processing (T&P) operation. 2. This inspection was a compliance inspection of the February 20, 2019 Notice of Violation. 3. The facility is in operation Monday through Friday 7:00 am – 5:00 pm and Saturday as needed. 4. The facility permit approves the operation of C&D landfill Phases 1 and 2 and the C&D T&P [sorting and recycling] operation. Plans for Phase 3A are currently under review. Please ensure no waste is placed in Phase 3A area until that area is approved. 5. The facility is accepting C&D in the south side of Phase 1, Cell1A. 6. Some new areas of waste were noted along the access road to the working face and on the west side slope above the sediment basin. These new areas will need to be covered within 7 days as discussed in the field. 7. All landfill footprints need to be designated by edge of waste markers. Some markers have been removed or damaged by equipment operating near markers. 8. The facility is currently placing waste in Cell 1A, and currently has Phase 3A under review and awaiting permitting approval. 9. Ensure a readily accessible unobstructed path to each groundwater monitoring well and landfill gas monitoring well location is maintained. 10. Any eroded rills on the landfill cap shall be repaired accordingly. 11. Windblown materials shall be collected by the end of each operating day. 12. The facility 2,200-gallon water truck, used for dust control, must be used to minimize and eliminate fugitive dust emissions. 13. Continue to seed and mulch all disturbed areas regularly until vigorous grass cover germinates sufficient to restrain erosion. 14. The Pinecroft Sedgefield Fire District can be contacted to address an emergency at the facility. 15. The facility has all-weather access roads. 16. The facility is secured by a locked gate. 17. The facility has a proper sign. 18. The PTO expiration date is October 3, 2023, consistent with the Franchise Agreement term. 19. The PTO expiration can be adjusted when a new Franchise Agreement is obtained. 20. All photographs were taken by Chuck Kirchner during the April 4, 2019 inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
