Teresa Bradford, DEQ – Solid Waste Section STATUS OF PERMIT: On January 29, 2019, the Solid Waste Section granted approval for the Charlotte Motor Speedway Landfill V to operate the western portion of Cell 2J. On March 12, 2019, the Solid Waste Section granted approval to operate Cell 2J, including the eastern portion. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .1626(2)(a). The northeast and the southern side of the working face was observed to have adequate cover. This violation is resolved. OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .1626(8)(d) states in part: “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” During the inspection, leachate from outbreaks on the southwestern side slope of Cell 2H were observed to have flowed into a slope drain which outlets into a ditch line off the lined disposal cell. Charlotte Motor Speedway Landfill V is in violation of 15A NCAC 13B .1626(8)(d) for failing to contain leachate within the lined disposal cell. On March 23, 2019, Mr. Mike Gurley, Environmental Engineer with Republic Services, submitted photographs showing that the areas off the lined disposal cell had been repaired. Mr. Gurley has also contacted Ms. Jackie Drummond, Hydrogeologist with the Solid Waste Section, regarding a soil sampling plan to access the impact of the leachate release. The soil sampling plan needs to be implemented as discussed with Ms. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 Drummond. Please note that additional measures may be required. A follow-up inspection will be performed to verify that the leachate outbreaks have been repaired. The facility consists of a MSWLF and a drop-off convenience area for residential waste. 2. The facility is permitted to receive solid waste generated from within the City of Concord, Cabarrus County, the State of North Carolina and the following counties in the State of South Carolina: Cherokee, York, Lancaster, Chesterfield and Chester. 3. Proper signage was observed at the entrance of the facility. 4. A gate is provided at the entrance of the facility to prevent unauthorized access. Operations Inspection of the MSWLF: 5. Waste was being placed in the western portion of Cell 2J. 6. The facility utilizes one tipper. 7. The working face appeared to be restricted to the smallest area feasible and compacted. 8. No unacceptable waste was observed. 9. The facility is permitted to use automobile shredder fluff mixed with soil, petroleum contaminated soil, tarps and foundry sand as alternative cover material. 10. Windblown litter was being collected during the inspection. 11. Edge of waste markers were being maintained. 12. Access roads were well maintained. 13. The leachate storage lagoon had adequate freeboard space. Additional treatment is available if needed in the leachate pre-treatment facility located adjacent to the leachate lagoon. Records Review: 14. Reviewed the monthly facility inspections, weekly leachate collection and pumping system inspections, training records, several waste determination records, random inspection records (4 regular waste inspections and 1 special waste inspection per day), quarterly methane monitoring records, semi-annual groundwater, surface water and leachate monitoring records, solidification pit log, leachate discharge records and monthly leachate sampling records required for the use of petroleum contaminated soil as an alternative cover material. 15. The leachate line jet cleaning for Cell 2J was conducted in February 2019. 16. Average daily tonnage for the facility is approximately 3000 tons per day. 17. 733,734 gallons of leachate was discharged to the Rocky River Waste Water Treatment Plant in February 2019. 18. A review of the quarterly methane monitoring reports found that a methane exceedance was documented in MMW-12 during the fourth quarter of 2018 sampling event. Please contact Jackie Drummond, Hydrogeologist, to discuss the necessary steps to confirm the extent of any gas migration towards the property boundary 19. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
