Waste was observed at the entrance and exit of the loading bay prior to the start of daily operations. OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit to Operate No. 7504T-TRANSFER-2005, Attachment 3, Part IV- General Conditions #18(a) states: "The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan." Polk County is in violation of 15A NCAC 13B .0203(d) for failing to clean the trailer loading area daily as specified by Permit to Operate No. 7504T-TRANSFER-2005, Attachment 3, Part IV- General Conditions Page 1 of 8 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section #18(a). During the February 28, 2019 inspection, the trailer loading bay was observed and a large amount of waste was noted on both sides of the transfer trailer. Waste was also observed outside the entrance and exit to the loading bay. To correct the violation, Polk County must clean the transfer trailer area at the end of each working day in accordance with the Permit to Operate No. 7504T-TRANSFER-2005, Attachment 1, Part I General Permit Conditions # 7. 2. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit to Operate No. 7504T-TRANSFER-2005, Attachment 1, Part I General Permit Conditions # 7 "This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in Attachment 1, "List of Documents for Approved Plan," and which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern." The Transfer Station Operations Plan, 3.2 Housekeeping and Litter Control states in part "Throughout and at the end of each working day, facility personnel should police the facility for litter. Collected litter should be placed in containers for proper disposal." Polk County is in violation of 15A NCAC 13B .0203(d) for failing to clean the trailer loading area daily as specified in the Transfer Station Operations Plan, 3.2 Housekeeping and Litter Control. During the February 28, 2019 inspection, the trailer loading bay was observed and a large amount of waste was noted on both sides of the transfer trailer. To correct the violation, Polk County must clean the transfer trailer area at the end of each working day in accordance with Transfer Station Operations Plan, 3.2 Housekeeping and Litter Control. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on February 28, 2019. 2. The facility is open to the public Monday through Friday, 8:00 am to 4:30 pm and on Saturday, 8:00 am to 4:00 pm. 3. Waste is transported from the facility by KR Drenth Trucking, Inc. to the Union County Regional Landfill in Enoree, South Carolina. Operations Inspection of the Transfer Station (7504T-TRANSFER-2005) 4. The inspection commenced at approximately 7:55 am, before the facility was open to the public. 5. One trailer was parked in the loaded trailer storage area at the time of this inspection. This trailer appeared to be leak resistant. Minimal waste was observed on the ground of the loaded trailer parking area. Page 2 of 8 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section 6. A partially filled trailer had been left in the loading bay following the previous days operation. Waste was observed on both sides of the trailer which had not been picked up at the end of the working day. The tipping floor and loading bay must be cleaned at the end of each working day. (See Observed Violations section of this report.) 7. Waste that had not been collected at the end of the previous working day was observed outside the entrance to the loading bay. Facility staff were actively cleaning the area. Dimensional lumber, bagged garbage, and other waste was noted outside the loading bay entrance. When questioned, staff stated that clean-up is accomplished by pushing waste out of the loading bay to the area beside the retaining wall where it can later be collected in the bucket of the loader. Material shall not be pushed out of the loading bay to clean the area. Whether by equipment or by hand, the material shall be collected inside the tunnel and not allowed to leave the building and the leachate collection system, as specified in the permit and approved operations plan. (See Observed Violations section of this report.) 8. Violations for waste outside the transfer station have also been observed during the January 5, 2016, January 5, 2017 and January 3, 2019 inspections. Failure to clean the loading bay was also cited in the June 27, 2018 inspection report. 9. Facility staff were cleaning the trench drains at the time of the inspection. Staff raked wet soil and waste off the top of the grates then removed the grates and began shoveling soil and waste out of the trench. The drain was clogged with waste and soil to the point that it could not function as designed. The trench drain is an integral part of the leachate collection system and as such must be functioning as designed to allow the facility to operate as permitted. Failure to clean the drain system on a daily basis will prevent the system from operating as designed, thus compromising the leachate collection system, and may result in additional enforcement action. The approved operations plan, section 4.1 Drainage Control and Wastewater Collection, states in part: "The trench drains are cleaned out daily following the cleanup of the Transfer Station floor." 10. A portion of the metal armoring on the west push wall has been compromised. A piece of the metal has broken off and is detached from the wall, allowing waste to get between the metal plate and the concrete wall. Repair the metal armoring to prevent material from becoming lodged between the armor and wall. 11. The center of the tipping floor has eroded exposing rebar in some areas. Staff stated that the floor was damaged during a fire that occurred approximately ten years ago. The fire caused this area of the floor to wear more quickly than the surrounding floor. The facility is currently working with Anchor QEA on an engineering plan to repair the damaged portion of the tipping floor. Other Comments 11. White goods containing refrigerants were observed to be stored separately and upright at the time of inspection. 12. During the previous inspection on January 3, 2019, grading work had resulted in waste mixing with soil in the area where scrap metal was being loaded into an open top trailer. The waste had been cleaned out of the soil and facility staff stated that they were in the process of acquiring molded concrete blocks to construct a wall in that area. 13. The cardboard baling area was found to be clean at the time of inspection. Please contact me if you have any questions or concerns regarding this inspection report.
