REGAN Secretary MICHAEL SCOTT Director February 26, 2019 Christopher Williams, General Manager Waste Industries, LLC 2211 Highway 301 Halifax, NC 27839 SUBJECT: RE: Notice of Violation Compliance Resolution Report Town of Weldon Transfer Facility 4205T-TRANSFER-1997 Halifax County Dear Mr. Williams, On September 5, 2018, Davy Conners and Andrew Hammonds, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. The facility was found in violation of the 15A North Carolina Administrative Code 13B .0402 (1 and 3), .0203 (d), 2017 Facility Permit, Attachment 3, Part VI, Number 17c, and Approved Operations Plan dated October 2016, Section 2.7.2, Number 12. As a result, a Notice of Violation (NOV) letter was issued on September 18, 2018. To achieve compliance, the facility was required to replace or repair transfer trailers so that they are leak resistant, implement measures to prevent future releases of leachate from leaking trailers, submit a sampling plan and conduct soil and water sampling in accordance with the sampling requirements noted in the NOV. On October 16, 2018, Smith + Gardner, Inc. (S+G) on behalf of the Town of Weldon Transfer Facility (Weldon Transfer) submitted a Sampling Plan and the Section requested changes to the Sampling Plan, specifically a larger sampling area. October 17, 2018, S+G on behalf of Weldon Transfer submitted a revised Sampling Plan. North Carolina 27699-1646 919,707,8200 Christopher Williams Compliance Resolution Page 2 of 3 February 22, 2019 On November 1, 2018, S+G on behalf of Weldon Transfer gathered samples for lab analysis in accordance with the approved sampling plan. On December 5, 2018, S+G on behalf of Weldon Transfer sent the Section an NOV Response Letter that outlined the corrective actions taken at the facility and soil sample analytical results. On December 13, 2018, the Section sent Weldon Transfer a Leachate Release Assessment letter in which Section stated Weldon Transfer is not required to conduct additional assessment related to this leachate release identified on September 5, 2018. On November 6, 2018, Weldon Transfer sent the Section a modified Operations Plan for approval. On January 2, 2019, having reviewed the modifications, the Section requested few changes to the ops plan. On January 7, 2019, Weldon Transfer submitted a revised Operations Plan for approval. The Section reviewed the changes and approved the plan on February 25, 2019. On January 29, 2019, the Section conducted a follow-up inspection of the facility. Details of the findings of the inspection can be found in the inspection report. This letter serves as confirmation that the requirements of the September 18, 2018, Notice of Violation have been satisfied and the violations have been corrected.
