Recorded in Currituck County, NC, Register of Deeds - Book 875 and Page 807. See information on Additional Comments page. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 – Expired Permit. Leighton Earwood (Currituck Co. Public Works Director) submitted renewal application on October 23, 2018. Last contact with permitting staff (Ethan Caldwell) was on February 01, 2019 from Leighton Earwood. Permit Renewal in process. 02 – Operating hours for this facility are: May 1 – September 30 / Monday – Friday 8am to 4:15pm. Saturday 8am to 4:15pm. October 1 – April 30 / Monday – Friday 8am to 4:15pm. Saturday 8am to Noon. 03 – This facility is Closed on Sundays, New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. 04 – Facility is secured by locking gates and fencing. 05 – Sign at facility entrance have required information. 06 – Interior roadways are constructed from all-weather material and maintained in good condition. 07 – Permit, Operations Plan and Site plan were reviewed. 08 – Facility is permitted to receive waste from Currituck, Camden and Dare Counties. 09 – Waste must be transported to the East Carolina Regional Landfill (0803-MSWLF-1993) in Aulander, Bertie County, North Carolina. 10 – Screening records were reviewed and were up to date. Records indicated scrap tires, propane tanks and other waste were being pulled out of loads. 11 – Incoming load tickets were reviewed and has required information. 12 – This facility has 4 Certified Transfer Station Operations Specialist: James Bolen, expires 10/9/2020, William Etheridge, expires 5/20/2021, Charlie Rome, expires 3/12/2019 (Has attended class for 2019) and David Lowe, expires 5/25/2019. 13 – This facility is permitted to receive White Goods, Yard Waste and Pallets and receives Scrap Tires. 14 – The Scrap Tires are laced into enclosed Box containers. 15 – White goods have the CFC’s removed before they are added to the scrap metal pile. 16 – Be sure to keep all CFC containing white goods upright until the CFC is removed to prevent leakage as noted in the 2/7/2018 inspection report, #17 & 19. 17 – Scrap metal pile is getting very large and outside of storage area. Need to start removal process. 18 – Tipping floor was not as clean as it should be before any loads were brought in. It was determined that this facility needed more water pressure to clean the tipping floor. John College and Leighton Earwood discussed using a high-pressure washer to ensure cleaning was done properly. Leighton had another County staff member bring one to the tipping floor and it was tested during this inspection and it worked well. There should not be any reason for the tipping floor to be clean now as required to be done by the end of the working day. 19 – There was a windblown trash issue from the day before and possibly longer when this inspection started before working hours. It had been raining the day before, but staff may need rain suits to be in compliance with the permit conditions. It was noted that most of the windblown trash had been picked up by the end of this inspection but the really small trash. This will need to be raked up. 20 – The Yard Waste needs to be screened better to prevent plastic and other non-conforming waste from entering into the grinder. 21 – It was also noted that there were several holes in the metal roofing and several rips in the sidewall metal. This needs to be repaired or replaced. 22 - As noted in the 2/7/2018 inspection report, #12 & 19, the trailer loading bay needs work on the incoming and outgoing apron to keep leachate inside of the trailer loading bay so it can drain into the leachate tanks and doesn’t run out on the ground 23 –Waste Management has access to this facility when closed to remove containers and bring in containers from convenient centers. One driver has put waste on the tipping floor without any Certified Transfer Station Operations Specialist on-site. Leighton called them to ensure this will not happen again or a Notice of Violation will be issued. 24 – There is corrective action needed at this facility due to the findings of this inspection. All items in this report were discussed with Leighton Earwood while on-site and a Notice of Violation will be issued if this happens again.
