The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. This inspection was conducted due to the report of a contractor drilling through the liner of the active landfill on
the afternoon of Friday, January 25, 2019. The verbal report of the incident was left in a voice message to Larry
Frost, Permitting Engineer, on Sunday, January 27, 2019 and received on the morning of Monday, January 28,
2019.
2. In a telephone conversation immediately preceding the inspection, Ms. Johnson explained that, to the best of her
knowledge, the county's drilling contractor had drilled to a depth of approximately 92' when gravel and liner -
like material was encountered.
3. The area of disturbance on the southwest slope of the landfill, identified as GW-39 on the facility site plan, was
inspected. The drill hole had been filled, the passive landfill gas vent installed, and the area restored with clean
soil. The vent itself was observed to be continuously emitting a cloud of gas, and a strong odor of methane
pervaded the area at the top of the landfill.
4. Mr. Shelton explained that he had come to work at the landfill during the time that fill operations had been
taking place in this area of disturbance. He stated that a temporary haul road had been constructed in the vicinity
of what is now GW-39, and leftover liner material had been used as a base upon which to pack stone for the
road. Mr. Shelton expressed his opinion that the liner material and gravel that had been brought up in the drill
bit may have been from this old roadway rather than from the landfill liner.
5. When questioned about the verbal report of the incident having been delayed outside the 24-hour reporting
window, Ms. Jolly stated that Joyce Engineering staff were managing the drilling contract.
6. Ms. Jolly was advised that a full incident report must be submitted to the Solid Waste Section no later than
Friday, February 1, 2019. Ms. Jolly reiterated that Joyce Engineering was managing the drilling contract and
would be responsible to compile and submit any required report. Ms. Jolly was reminded that, although Joyce
Engineering is contracted to manage aspects of the facility planning and operations, Rockingham County is
ultimately responsible for complying with the conditions of its permit to operate and all state statutes and rules
that govern the management of solid waste at its facility.
7. The operations area and working face were observed in passing during this inspection. The area was wet with
deep, soft mud that was difficult to navigate. It is recommended that additional rock and soil be placed in
the operating area surrounding the working face to help mitigate the mud, to enable vehicles and
equipment to maneuver more safely, and to limit the amount of waste exposed during daily operations.
8. The working face appeared to be large with poorly delineated boundaries. A large volume of exposed waste had
been churned up by equipment and vehicle operation in the tipping area and approach. Piles of dirt mixed with
waste were located at the fringe of the working face area. Mr. Shelton explained that soil cover was pulled off
and laid aside at the beginning of the operating day. When questioned, Mr. Shelton stated that landfill staff
worked to cover all waste at the end of every operating day. Ensure that all waste is covered completely with
a minimum of 6" of clean soil or other approved alternative cover material at the end of each operating
day as required by 15A NCAC 13B .1626(2). *Please note that the issue of churned up waste in the
operating area surrounding the working face was also noted in the report covering the previous inspection
on October 30, 2018. *
9. The side slopes of the landfill were observed from a vehicle on the perimeter access roadway. In general, slopes
with an established vegetative cover appeared to be in good condition; however, slopes with a soil cover or new
vegetative cover appeared to have been damaged by rain and snow. Some erosion rills were visible along the
working face access and along the northern and eastern slopes. Mr. Shelton stated that continuous storm events
have largely prevented the use of equipment on the slopes to effect repairs. He added that, when slope
conditions permit, repair work resumes. Please ensure that any waste that becomes exposed as a result of

erosion is completely covered by the end of every operating day.
10. Facility access roadways were of all-weather construction and observed to be in good condition, with the
exception of the approach to the working face. (See comment #7 above for additional information.)
11. An incident report covering the January 25, 2019 drilling incident was submitted by Jenny Johnson, Joyce
Engineering, to the Solid Waste Section on Thursday, January 31, 2019.
