Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 28, 2019. 2. The permit to operate Phase 3, Cell 1 was issued on May 31, 2018; however, filling has not begun in the new cell. 3. The facility is open to the public Monday through Friday, 7:30 am to 4:30 pm and Saturday, 8:00 am to 2:00 pm. Operations Inspection of the MSW Landfill Unit (5703) 4. The working face was small, compact and no unacceptable material was observed. 5. Windblown litter was minimal and was being managed well at the time of inspection. 6. The access road was constructed of all-weather material and was in good condition at the time of inspection. The facility collects and separates clean inert debris for use as roadbed material. 7. A small amount of exposed waste was observed to the west of the working face. The exposed waste appeared to be a result of recent rainfall and the inability to get equipment to the area due to the wet conditions. Facility staff were in the process of repairing the area during the inspection. 15A NCAC 13B .1626(2)(a) states "Except as provided in Sub -Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging." Operations Inspection of the Recovery Center 8. The recovery center is located to the east of the landfill. 9. All non-commercial loads (excluding construction and demolition debris) are directed to the recovery center. 10. Incoming MSW is dumped onto the tipping floor, then loaded over a wall into an open top trailer and transported to the working face. 11. The floor drains were observed and appeared to be clean and working properly. 12. No unapproved material was observed on the tipping floor. 13. The recovery center also accepts, cardboard, electronics, fluorescent tubes, thermostats, and shingles for recycling. 14. The recovery center was well managed at the time of inspection. Operations Inspection of the Yard Waste Treatment and Processing Area 15. The yard waste area is located to the north of the scale house. 16. The facility accepts untreated, unpainted pallets and wood, leaves and land clearing debris. 17. The material is ground and mixed with soil for approved alternative daily cover for the landfill. No ground material is distributed to the public. 18. The facility has a roll off container to dispose of any unapproved material that may be mixed into incoming loads. 19. The yard waste treatment and processing area was well managed at the time of inspection. Operations Inspection of the White Goods Area 20. The facility collects white goods and scrap metal for recycling. Refrigerant -containing white goods are segregated from all other metals. 21. Facility staff conduct the refrigerant recovery, mark empty units with an X and then place them into the scrap metal pile. 22. The scrap metal and white goods that are collected are sent to Desoto Trail in Franklin, NC for recycling.
