Issurance Date: January 30, 2019 FID:1260731 Page 2 of 14 ATTACHMENT 1 GENERAL PERMIT CONDITIONS/INFORMATION PERMIT APPROVAL TO OPERATE DATA TABLE PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environment Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(e), a land clearing and inert debris (LCID) solid waste management facility permit may be combined in two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct and Operate shall expire on June 28, 2023 according to Rule 15 NCAC 13B .0563(4). The Permit Approval to Construct conditions are contained in Attachment 2 of this permit and the Permit Approval to Operate conditions are contained in h Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. The permit (DIN19165) for this landfill facility, dated June 28, 2013, was recorded by the Davidson County Register of Deeds on August 19, 2013 in Book 2114 on Pages 2452 through 2462 (FID108701). 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a LCID landfill and a reference by book and page to the recordation of the permit. 5. By beginning construction or receiving waste at the facility the permittee shall be considered to have accepted the terms and conditions of this permit Rule 15A NCAC 13B .0203(d). 6. Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. 8. This permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with applicable statutes and rules. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to, a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 9. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including, but not limited to, approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. The landfill property encompasses 81.86 acres. On October 3, 2018, the landfill property ownership was changed to Andrew B. Veach who owns 20.553-acre parcel, a portion of the 81.86-acre land. The waste disposal boundary encompassing 8.88 acres inside the 20.553-acre landfill, that is operating under Veach Landfill L.L.C. and managed by Andrew B. Veach and Michael Phillips. Issurance Date: January 30, 2019 FID:1260731 Page 5 of 14 ATTACHMENT 2 CONDITIONS OF PERMIT APPROVAL TO CONSTRUCT PART I: GENERAL FACILITY CONSTRUCTION CONDITIONS 1. Construction of all solid waste management units within this facility must be in accordance with the 15A NCAC 13B Rules and the pertinent approved plans as identified in the “List of Documents for Approved Plan,” Attachment I of this permit. 2. A copy of this permit and the approved plans shall be maintained at the facility. EROSION AND SEDIMENTATION CONTROL REQUIREMENTS 3. All required sedimentation and erosion control measures must be installed and operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill units during the service life of the facility. 4. All earth disturbing activities at this landfill facility must be conducted in accordance with the approved Erosion and Sediment Control Plan (FID 1260730), the Sedimentation Pollution Control Act of 1973 (15 NCAC 4), and be consistent with any other local, state or federal requirements. 5. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. 6. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The permittee must notify the Section of any sedimentation and erosion control plan modifications. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT CONSTRUCTION CONDITIONS Not Applicable. Issurance Date: January 30, 2019 FID:1260731 Page 6 of 14 VEACH LANDFILL, L.L.C, 2909-LCID-2013 1. Per the North Carolina Solid Waste Management Rules (Rules) 15A NCAC 13B .0201(c) and (e), this permit approves the landfill new property boundaries, waste disposal boundaries, and construction of Veach Land Clearing and Inert Debris (LCID) Landfill as shown on the drawings of the approved plan (FID 1260730). 2. The permit approves the permittee to construct the landfill which contains a total gross capacity of approximately 60,000 cubic yards (CY) within the permitted waste footprint of approximately 8.88 acres. Gross capacity is the measured volume between the bottom of waste at the elevation of 800-feet above mean sea level (amsl) and the top of final cover at the elevation up to approximately 824-feet amsl with a three (horizontal) to one (vertical) side slope as shown on drawing Sheet Nos C2.0, C4.0, and C4.1 (FID 1260730). 3. The permittee must develop the LCID Landfill by phases. Revisions to the approved design or construction of any landfill phases or cells require written approval of the Section in accordance with N.C.G.S. 130A-294(a3)(3). PRE-OPERATIONAL CONDITIONS 5. The permittee must complete the following Permit Conditions prior to receiving solid waste in a new landfill phase: a. The new landfill base, where the LCID waste will be disposed of must be constructed to the elevation of 800 feet amsl with exterior slopes no steeper than 3 (horizontal) to 1 (vertical) as shown on drawings Sheet Nos. C2.0, C4.0, and C4.1 (FID 1260730) and according to Rules 15A NCAC 13B .0564(8)(d) & .0565(3)(j), respectively. b. A written construction certification that is signed by a NC Registered Professional Engineer must be submitted the Section to certify that the waste disposal unit(s) has been constructed in accordance with the approved plans and Rule 15A NCAC 13B .0564(8)(d). As-built survey drawings prepared by a NC Registered Land Surveyor must be submitted the Section to certify that the waste disposal unit(s) has been constructed in accordance with the approved plans and Rule 15A NCAC 13B .0564(8)(d) and .0564(9). d. A sign must be posted at the entrance as required by the Rule 15A NCAC 13B .0566(16). e. The disposal unit boundary must be accurately identified with permanent markers. f. Completion of constructing and installing all required and approved measures, devices, and structures to prevent soil erosion, control sedimentation, manage surface water drainage, and to protect surface water-body in accordance with the approved Erosion and Sediment Control Plan (FID 1260730) and the Permit Conditions Nos. 3 through 6, Part 1 of Attachment 2. g. A site inspection and pre-operative meeting may be conducted by a representative of the Section. The permittee must notify the Section’s Senior Environmental Specialist and make arrangements for the site inspection and pre-operative meeting. h. After completion of the requirements in subparagraphs a. through g. above, the Section Senior Environmental Specialist will notify the Permitting Branch Supervisor by letter or email that the pre-operative requirements have been met and that the unit(s) may commence receiving waste. The permittee will be copied on the notification and may begin receiving waste at that time. PART VI: TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) Not Applicable. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT Not Applicable. - End of Section- ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE PART I: GENERAL FACILITY OPERATION CONDITIONS Facility Permit No: 2909-LCID-2013 Permit Approval To Construct & Operate Veach Landfill, L.L.C. Issurance Date: January 30, 2019 FID:1260731 Page 8 of 14 1. Pursuant to N.C.G.S. 130A-309.09A(g), the permittee must not knowingly dispose of, or accept for transfer for subsequent disposal, solid waste that is generated within the boundaries of a unit of local government that by ordinance: a. Prohibits generators or collectors of solid waste from disposing of that type or form of solid waste. b. Requires generators or collectors of solid waste to recycle that type or form of solid waste. 2. This facility is permitted to receive non-hazardous solid waste, as defined in N.C.G.S. 130-290 (a)(35). The permitted wastes are received at the facility must be generated within Davidson and Forsyth counties at the discretion of the Davidson County Board of Adjustment (FID 1260730), except where prohibited by North Carolina General Statutes Article 9 of Chapter 130A and the 15A NCAC 13B Rules. Revisions to the design or operation of the facility or changes to the service area must be submitted to the Section for review prior to any changes. 3. The facility operator must complete an approved operator training course in compliance with N.C.G.S. 130A-309.25. A responsible individual certified in waste operations must be on-site during all operating hours of the facility at all times while open for public use. 4. The permittee must actively employ a training and screening program at the facility prepared in accordance with applicable Rules, N.C.G.S. 130A-295.6(g), and the approved operation plan (FID 1260730) for detecting and preventing the disposal of excluded or unauthorized wastes. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures. b. Records of any inspections. c. Training of personnel to recognize hazardous, liquid, and other excluded waste types. d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes. Facility Permit No: 2909-LCID-2013 Permit Approval To Construct & Operate Veach Landfill, L.L.C. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. 6. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq. and rules promulgated under 15A NCAC 4. All required sedimentation and erosion control measures must be installed and operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill unit during the service life of the facility. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The Section must be notified of any sedimentation and erosion control plan modifications. 7. The permittee must well maintain permanent physical markers that accurately identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill facility. 8. Site access controls must be installed and operational, and access roads must be of all- weather construction and properly maintained. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT(S) Not Applicable. PART III: CONSTRUCTION AND DEMOLITION DEBRIS LANDFILL UNIT(S) Not Applicable. PART IV: INDUSTRIL LANDFILL UNIT(S) Not Applicable. PART V: LAND CLEARING AND INERT DEBRIS LANDFILL UNIT OPERATION CONDITIONS VEACH LANDFILL, L.L.C., 2909-LCID-2013 1. This Permit Approval to Operate shall expire June 28, 2023 according to Rule 15A NCAC 13B .0563(4). According to N.C.G.S. 130A-294(a3)(2) the permittee must submit a request to the Section for permit review and must update pertinent facility and operations plans meeting requirements of Rules 15A NCAC 13B .0565 and .0566. 2. This landfill unit must conform to the operational requirements of the Rule 15A NCAC 13B .0566 and to the operational plan (FID 1260730) required by Rule 15A NCAC 13B .0565(4). This permit authorizes the permittee to continue operating Veach Landfill, L.C.C. unit which has the approved total gross capacity of approximately 60,000 cubic yard (CY) within the permitted waste footprint of approximately 8.88 acres (FID 1260730). Gross capacity is the measured volume between the bottom of waste and the top of final cover. 4. Operation of any landfill future phases or cells requires written approval of the Section constructed in accordance with applicable statutes and rules effective at that time. 5. This landfill unit is permitted to receive the following wastes for disposal: a. Land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block in accordance with Rule 15A NCAC 13B .0563; and b. Asphalt in accordance with N.C.G.S. 130A-294(m). c. Waste acceptance requirements may be affected by future revisions and amendments to the North Carolina General Statutes, or to the Rules. 6. Amendments or revisions to the North Carolina General Statutes or to the North Carolina Solid Waste Management Rules or any violation of ground water standards may necessitate modification of the approved design or operation plans, waste acceptance requirements or may require closure of the facility. 7. Solid waste must be restricted to the smallest area feasible and compacted as densely as practical into cells of this landfill unit by proper construction equipment according to Rule 15A NCAC 13B .0566(3). 8. The permanent markers that accurately delineate the waste disposal boundary must be properly maintained. 9. Excavation, grading, and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1) as shown on the drawings of the approved plan (FID 1260730) and according to Rule 15A NCAC 13B .0565(3)(j). 10. Pursuant to Rule 15A NCAC 13B .0566(12), open burning of received solid waste is prohibited. If a fire occurs, the permittee must provide verbal notification to the Section within 24 hours of the occurrence followed by a written report of the details of the fire within 10 working days of the occurrence. The report must include the cause, the location(s) on the premises, the dimensions and volume of material involved, a Facility Permit No: 2909-LCID-2013 Permit Approval To Construct & Operate Veach Landfill, L.L.C. Issurance Date: January 30, 2019 FID:1260731 Page 11 of 14 description of emergency response activities with results, and a description of mitigation measures implemented to reduce or eliminate conditions leading to the fire. Other conditions may be required based on the severity or nature of the fire. 11. Pursuant to Rule 15A NCAC 13B .0566(13), the permittee must conduct routinely monitoring to ensure that the concentration of explosive gases generated by the LCIDLF facility must not exceed: a. Twenty-five percent (25%) of the lower explosive limit for the gases in facility structures. b. The lower explosive limit for the gases at the property boundary. 12. A sign must be posted maintained at the entrance as required by Rule 15A NCAC 13B .0566(16). COVER MATERIAL REQUIREMENTS 13. Solid waste must be covered with a suitable soil cover at least once per month or when the active area reaches one (1) acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors, or excessive water infiltration in accordance with Rule 15A NCAC 13B .0566(4). 14. Pursuant to Rule 15A NCAC 13B .0564(7), the permittee must maintain a supply of cover material adequate to cover the working face at the landfill at all times in case of an emergency or fire. The earthen cover material must be effectively compacted to minimize soil erosion and repaired in a timely manner when the soil cover is eroded by surface water. 15. Vegetative ground cover sufficient to control erosion must be established within 30 (thirty) working days upon completion of any phased development of the landfill in accordance Rule 15A NCAC 13B .0566(7). 16. Per Rule 15A NCAC 13B .0566(5), within 120 calendar days after completion of the final disposal operations, the permittee must close and cover the disposal area with a minimum of one (1) foot of suitable soil cover graded and sloped to allow surface water runoff in a controlled manner. DRAINAGE AND EROSION CONTROLS AND WATER PROTECTION REQUIREMENTS Facility Permit No: 2909-LCID-2013 Permit Approval To Construct & Operate Veach Landfill, L.L.C. Issurance Date: January 30, 2019 FID:1260731 Page 12 of 14 17. All required sedimentation and erosion control measures must be installed and maintained to mitigate excessive on-site erosion and to prevent silt from leaving the site of the landfill unit during the service life of the facility in accordance with Rules 15A NCAC 13B .0564(8)(a), (b) & (c) and .0566(6). 18. Ground water quality at this facility is subject to the classification and remedial action provisions of 15A NCAC 2L and Rule 15A NCAC 13B .0566(15). 19. Solid waste must be placed a minimum of four (4) feet above the seasonal high-water table at the elevation of 800 feet amsl according to the approved plan (FID 1260730) and Rule 15A NCAC 13B .0564(8)(d). 20. Surface water must be diverted away from the operational area and must not be impounded over or in waste, and solid waste must not be disposed in standing water according to Rules 15A NCAC 13B .0566(10) and (11), respectively. 21. Leachate must be properly managed on site using the current best management practices in accordance with Rule 15A NCAC 13B .0566(14). PART VI: TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) Not Applicable. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT 1. The facility may accept “recovered material” or “recyclable material” as defined in N.C.G.S. 130A-294(a)(24) and (26), respectively that are generated from the service areas set forth in the Permit Condition No. 2, Part I of Attachment 3 of this permit. The Section must be notified of proposed changes to the approved waste stream, service area and/or the receiving facility. 2. Recyclable or recovered materials may be received and processed as described in the approved plan (FID 1260730). The received unprocessed materials and final products shall be placed at the designated locations as shown on the drawing Sheet No. C2.0 (FID 1260730). 3. Recovered or recyclable material must be managed as a valuable commodity in a manner consistent with the desired use or end use. The permittee must operate and manage received recyclables or recovered material at this facility according to the requirements set forth in N.C.G.S. 130A-309.05(c) and the approved plan (FID 1260730). Seventy-five present (75%), by weight, of the unprocessed waste of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, must be removed from the facility by December 31 of the same year. 5. This facility is permitted to receive and temporarily store the following recovered wastes for treating and/or processing for reuse or sale. These treatment and process units as defined in Rule 15A NCAC 13B .0101(49) are located inside the landfill facility; therefore, the permittee must comply with Rule 15A NCAC 13B .0302 for managing received solid waste at these units. a. Concrete Process Area. i. Approved waste streams are unpainted, uncontaminated concrete products or concrete blocks which can be stockpiled and/or processed at the approximately 1.2-acre area as shown on the drawing Sheet No. C2.0 (FID 1260730). ii. No wet concrete shall be accepted at this area. iii. The maximum storage volumes (both processed and unprocessed volumes) is approximately 1,000 tons at any given day. iv. The concrete products or concrete blocks can be used as beneficial fill at the landfill facility if fill activities follow the requirements set forth in Rule 15A NCAC 13B .0562. b. Wood Waste Collection/Processing Area. i. The area that encompasses approximately 0.7 acres is permitted to operate a treatment and processing unit and/or the wood wastes collection area. ii. The area is permitted to receive, process, and store low nitrogen wood wastes, such as tree limb, truck and clean, unpainted, uncontaminated wood. iii. Pretreated wood, engineering wood, leaves, and grass clippings are prohibited to be acceptable at this area. iv. The permittee shall process or store no more than 600 cubic yards of wood wastes at this area at any time. Each stockpile shall have the maximum height of less than 12 feet and maintain a 25-feet clear distance or perimeter from drainage ditches and swales, around processing area, and between stockpiles of raw wastes and ground material to allow for inspection, monitoring temperature, and firefighting. vi.
