Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 9 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 9, 2019 2. The facility is permitted to receive solid waste generated by Blue Ridge Paper Products, Inc. 3. The facility accepts fly ash from multi -boilers, lime waste (mud), wastewater treatment sludge, wood waste debris, cinders, biosolids and asbestos containing material (ACM). ACM is landfilled in a separate area from all other materials. 4. The ACM disposal area is located on the east side of the facility and no issues were observed. The area had good vegetative ground cover established. Facility staff stated that the next delivery of ACM from a construction project at the plant was scheduled to occur on January 10, 2019. 5. Leachate is collected and transported through a gridwork of perforated pipes and drainage layers that are placed along the side slopes of the landfill and between lifts. Leachate flows by gravity through the landfill, collected in the 6D South basin, then pumped from the landfill to the leachate collection ponds and ultimately pumped by force main to the Canton Mill wastewater treatment plant. 6. On Friday, December 28, 2018, a significant weather event hit Western North Carolina, affecting Landfill No. 6. Rain water data collected at the facility showed that 1.71 inches had fallen as of 6:45 am at the facility, and no issues were observed. Between 6:45 am and 10:30 am an additional 1.07 inches of rainfall was recorded. The additional rainfall, in conjunction with saturated conditions from previous rainfall events, caused the 6D South basin to overflow across the access road, down an embankment and into stormwater basin 6-15. Facility staff first observed the overflow at 10:45 am and began immediate measures to contain and stop additional overflow. At approximately 10:55 am, facility staff took proactive steps, taking samples from stormwater outfall 6-15 and testing them for pH, TSS, COD, Fecal Coliform. Mr. Frazier called Lee Hill, Environmental Senior Specialist at the NCDEQ Asheville Regional Office, to report the incident, as required. Mr. Hill was unavailable, and Mr. Frazier left a message. Mr. Frazier then contacted Deb Aja, Western District Supervisor, to report the occurrence. Ms. Aja notified Stan Aiken, Regional Engineer, Division of Energy, Mineral and Land Resources (DEMLR) and Landon Davidson, Water Quality Supervisor, about the release. On Saturday, December 29, 2018, Mr. Frazier sent photos of the areas where the incident occurred. On Monday, December 31, 2018, Elizabeth Werner, Hydrogeologist for the Solid Waste Section, requested that the facility submit a Leachate Release Sampling Plan. On Friday, January 4, 2019, results from the December 28t` outfall sampling were provided to Solid Waste Section and DEMLR staff. On Wednesday, January 9, 2019, the facility submitted the Leachate Release Sampling Plan; the plan was approved by the Solid Waste Section on the same date. 7. Areas affected by the leachate release, including the access road, embankment, stormwater basin 6-15 and outfall 6-15 were inspected and no visual signs of ash or waste were visible. Mr. Frazier stated that the facility lost power to the leachate pond pumps at approximately 9:30 am on Sunday, January 6, 2019. These pumps transfer leachate to the wastewater treatment plant. He further stated that, due to power fluctuations, part of the pump control board was damaged and replacement parts had been ordered. 9. The leachate ponds were observed and there were approximately 18 inches of freeboard remaining in the ponds. The perimeter of the ponds was walked, and no issues were observed. 10. Mr. Frazier stated that facility staff were working to install a temporary pump to pump the leachate to the wastewater treatment plant. After the inspection at 3:21 pm, Mr. Frazier called to confirm that the temporary pump had been set up and had pumped approximately 10,000 gallons of leachate. He explained that the pump would be turned off overnight as a safety precaution since no staff would be onsite to monitor. Mr. Frazier stated that he hoped to have the replacement parts for the main pumps by Thursday, January 10, 2019. 12. On January 10, 2019, Mr. Frazier sent an email stating that new motor starters, coils and fusing had been installed, and that the pumps had been brought back online at 10: 10 am. He indicated that normal leachate pumping operations had been resumed. He also stated the 6D South basin volume was back to its normal level, but that it would be monitored closely. 13. On January 14, 2019, Mr. Frazier sent an email stating that there are currently 38 to 40 inches of freeboard in the leachate ponds and that pumping to the wastewater treatment plant is ongoing at the rate of 137 gallons per minute.
