UNRESOLVED Observed Violation from 2/20/2018 (inspection report): 15A NCAC 13B .0505 (5)(b) Surface water shall not be impounded over or in waste. The City of Durham is in violation of the above rule in that water is ponding over waste in many areas across the entire cap of the landfill. The most significant areas of ponding water are west of the access road going back to the yard waste area and along the east side of the landfill near the service road. These areas must be repaired to prevent ponding of water over waste. Areas of subsidence should be attended to on a continuing basis. Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Water ponding west of the access road Water within the edge of waste along east service road OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS The facility is located behind the City of Durham Transfer Facility (3212T), via service road. The service road also provides access to the City of Durham Large, Type 1 Solid Waste Compost Facility (3204) and the City of Durham Temporary Disaster Debris Staging Site (DS32-004). Both 3204 and DS32-004 are located behind the closed landfill. The service road used is atop the landfill. The facility ceased operation by December 31, 1997 as stated in the SWS record of communication, dated January 14, 1998 and in accordance with the January 1, 1998 requirement to cease operation as stated in the transition plan approval letter, dated July 29, 1996. The facility [initial] transition plan was submitted to SWS dated April 1994. The revised closure schedule approval letter issued by the SWS, dated June 9, 1998, approved the completion of closure activities by December 16, 1998. Ground water is sampled from six wells (MW-2, MW-3R, MW-4R, MW-5, MW-9R and NES-3) and surface water is sampled from three surface water locations (SW-2, SW-3 and SW-4). MW-9R serves as the upgradient monitoring well for the facility and S-4 is the upstream surface water monitoring point. Water levels are also collected from five locations (MW-6R, MW-7R, MW-10, PZ-2R and PZ-3). The following observations were made during the November 21, 2018 inspection. Please resolve all non-compliance issues (in bold) within 30 days of receipt of this report. 15A NCAC 02C .0108(g) The well shall be constructed in such a manner that water or contaminants from the land surface cannot migrate along the borehole annulus into any packing material or well screen area. See Permanent and Temporary Groundwater and Landfill Gas Monitoring Wells, Piezometers, and Probes memo for more information. a. Landfill gas extraction wells were uncovered and contained rainwater. Groundwater monitoring well MW-4R is in a low-lying area and during the inspection the well was surrounded by water. 15A NCAC 02C .0108(k) All non -water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use. One of the well heads along the back -service road was opened and unlocked. Unable to access to see the well number due to overgrown vegetation. 3. 15A NCAC 02C .0108(1) All non -water supply wells shall be equipped with a steel outer well casing or flush - mount cover, set in concrete, and other measures sufficient to protect the well from damage by normal site activities. Several areas throughout the landfill, had ruts, possibly caused by mowing equipment or traffic over There was woody growth in several places on the landfill. The landfill was only partially mowed, probably due to the rainy weather. When the ground dries, the landfill must be mowed and growth cut down so seeps or leachate breakouts can be observed and immediately fixed. 6. A large area of soil was stored on the top of the landfill disturbing the cap. Approval of this type of storage is required by the Solid Waste permitting engineer. If the City does not already have written approval please, contact Sherri Stanley, Permitting Branch Head, to obtain written approval. If the City does not receive approval the soil must be removed.
