The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
This facility is a permitted industrial landfill. It is permitted to receive solid waste generated by or at the Duke
Energy, L.V. Sutton Energy Complex property. Acceptable waste types include, but are not limited to: coal
combustion residuals, wastewater treatment sludge, vacuum truck waste, waste soils (i.e. from ash removal activities or
soil that has contacted petroleum), and small quantities of inert debris from CCR (Coal Combustion Residuals) unit
decommissioning activities. The Permit to Operate shall expire September 21, 2026.

1. The Permit and Operations Plan must be maintained on-site as required and were reviewed during the site
inspection.

2. The facility is secured by a locked gate. Personnel are on site during operating hours. The facility has all
required information on signs.

3. Trans Ash personnel are responsible for daily landfill operations; certified staff are always present when the
landfill is in operation.

4. Active operations are occurring in Cells 4, 5 and 6. Cell 4 is nearing final grade. Cell 6 was too wet for active
filling on the day of the inspection but waste placement was occurring in Cells 4 and 5. Cell 7 is active for the
purposes of leachate management but not yet being actively filled.

5. Between 12/1/18 and 12/7/18, a total of 43,644.87 tons of coal combustion residuals have been landfilled onsite.
During the month of November 2018, a total of 171,378.84 tons of CCRs were landfilled onsite and the year-to-
date tonnage landfilled between 1/1/18 and 12/7/18 was 2,780,268.10 tons. The facility averages 8,000-12,000
tons of CCR landfilled per day depending on operating conditions. The facility goal was to landfill
approximately 2 million tons of CCR in 2018.

6. Significant rain in excess of 3 inches occurred the weekend prior to the inspection. Conditions in the landfill
were too wet for normal operations on Monday and Tuesday. Conditions in the landfill were wet at the time of
the inspection and slope erosion was observed on the west side of the active cells. Repairs were underway
during the inspection. The facility should continue to take steps to limit erosion on the side slopes and
quickly repair erosion rills after heavy rainfall events.

7. The leachate waste water treatment system was fully operational at the time of the inspection.

8. Ponded leachate was visible around chimney drains during the inspection but chimney drains appeared to be
functioning as designed. Ponded leachate was not observed elsewhere in active areas.

9. All repairs from the effects of Hurricane Florence have been completed on Cell 8.
