Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS: 01 – This site visit was conducted to discuss plans to move forward with the leachate seep (on-site) on 2 areas of this closed MSWLF. 02 – Discussions on the top berm removal that was noted on the last inspection (8-9-17) when the seep was found. 03 – The seep was minimal during this inspection and there was no water ponded on the top around the berm. 04 – It was discussed that Currituck Co may want to consult with their engineering consultants for further information on corrective action. 05 – Perry Sugg, NCDEQ-DWM was called about this plan in hopes that the corrective action to control this seep would help correct elevated levels of Arsenic levels in 1 groundwater monitoring well. 06 – Mr. Earwood and Ms. Perry will keep the DWM informed of plans moving forward.
