STATUS OF PERMIT: Permit To Operate (PTO) issued April 19, 2016 Permit To Construct (PTC) issued in conjunction with PTO PTO expiration date April 19, 2021 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On August 27, 2018, John Patrone met with Robert Fryar to conduct a comprehensive inspection of the Fryar Grading and Hauling, Inc. LCID Landfill on McLeansville Road in McLeansville, Guilford County. 1. The facility is a land clearing and inert debris (LCID) landfill owned and operated by Robert Fryar. 2. The facility permit, site plan, and operations plan were discussed. 3. The facility is open to the public. 4. The facility is in operation Monday through Friday 7:30 am to 5:00 pm [8:00 am to 4:30 pm November through February]. 5. The facility is permitted to receive waste generated within Alamance and Guilford Counties. 6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 7. During the inspection, the working face appeared to be properly maintained. 8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 9. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 10. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1). 11. A ready supply of soil shall be available for cover material. 12. Permanent edge of waste markers have been installed. 13. The facility annual report (FAR) was received by the SWS, dated July 23, 2018. Estimated facility throughput for July 2017 through June 2018 is 35,100 yd3. 14. There was no indication of erosion or runoff. 15. Access roads are of all-weather construction. 16. The facility is secured by a locked gate. 17. The facility has a proper sign. 18. The PTO expiration date is April 19, 2021. 19. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
