The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS; 01 – This Partial Facility Compliance was un-announced.
02 – Security is provided by a locking gate. Need to put a sign with contact information in the event of an emergency.
03 – Site is not open to the public. Only the Town of Kill Devil Hills has access to use this site. 04 – During this inspection it was noted that there are painted pallets, and a plastic bag in the unground
material. Please remove the non-conforming waste from piles before grinding.
05 – For the most part, the road is made of all-weather materials. 06 – All ground material is placed in windrows.
07 – No records were reviewed during this inspection. 08 – Please refer to the Yard Waste Notification Facility Guidance document that was given to Lynn Lindsey on the last inspection to see the un-accepted materials.
09 – Overall site appears to be managed well. 10 – Digital pictures taken during this facility inspection. Some attached to this report.
