The permit shall expire on June 15, 2021. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is permitted to receive solid waste generated within Ashe, Avery, Caldwell, Watauga, and Wilkes Counties. 2.) The permit and operations plan were verified. The documents were current and available upon request. 3.) A gate was provided at the entrance to the facility to prevent unauthorized access. 4.) The working face was less than one-half acre at the time of inspection. 5.) Majority of waste was covered with soil. 6.) The landfill is used primarily for the disposal of inert debris such as concrete, rock, brick, concrete block, and broken asphalt. Wood waste is taken to the Treatment and Processing Area for eventual grinding into mulch. 7.) During the inspection, a small load of waste was offloaded that contained burned material. Much of this waste was unidentifiable and multiple aluminum cans were observed. It was discussed that such loads of waste should not be accepted at the LCID landfill if waste cannot be easily recognizable as acceptable for disposal in the landfill. Mr. Buck stated that the waste would be removed from the area and properly disposed. 8.) The access road leading to the landfill was of all-weather construction and well maintained. 9.) Gas Probe “TP 1” was observed. The device was surrounded by large boulders to prevent damage from equipment and was adequately labeled. 10.) Surface water appeared to have been directed away from the landfill. 11.) Much of the southern and western facing slopes had been seeded with good germination of seed. Efforts to stabilize exposed soil are appreciated. 12.) Methane monitoring of gas probe “TP 1” was being performed quarterly as stipulated in the approved operations manual for the facility. Records for monitoring events performed on 3/1/17, 6/27/17, 8/3/17, 10/4/17, and 3/29/18 were verified. No exceedences above applicable standards were found. Operations Inspection of the Treatment and Processing Unit: 13.) The facility is permitted to receive wooden pallets constructed of unpainted and untreated natural wood, land clearing debris as defined by 15A NCAC 13B .0101(23), and yard trash as defined in 15A NCAC 13B .0101(55). 14.) Pallets and unground land clearing debris were being maintained in separate stockpiles at the time of inspection. 15.) During the inspection, multiple pieces of plywood were observed within the pallet stockpile. As previously noted, the approved operations manual for the facility states: “Engineered (glued) wood products shall not be managed in this area.” x Please ensure all engineered wood products are removed from the area for proper disposal. x During the June 5, 2018 inspection, Ms. Watson explained that is the facility’s policy not to allow acceptance of engineered wood at the Treatment and Processing Area. x Mr. Buck explained that he was exploring different options to prevent unacceptable material such as engineered wood products from being deposited at the Treatment & Processing Unit such as providing a staff member to permanently man the T&P Unit. x As noted on the previous inspection report, if the County wishes to accept this material, please contact Allen Gaither, Permitting Engineer to obtain approval. However, no compost operations were taking place on site. 17.) No objectionable odors were observed. 18.) No significant ponding was observed on site. 19.) It appeared that off-site surface water had been directed away from the area. 20.) A new access road was being constructed into the area to allow for better access and movement by facility equipment and customers. 21.) Good access was provided around stockpiles of material to allow for access by firefighting equipment.
