Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 8 ADDITIONAL COMMENTS 1. The purpose of this inspection was to conduct a closure evaluation of the Bladen Co. Closed MSW recapping project. 2. The site must meet the original conditions of the approved facility closure drawing. 3. If the County would like to make the changes during the project permanent, a final drawing of the site must be submitted for approval to NC DEQ Solid Waste Section, Ed Mussler, Section Chief by email to ed.mussler@ncdenr.gov. The drawing shall account for the changes in contours, drainage and erosion control measures and any other alterations made during the recapping project. Please, call Mr. Mussler at 919-707- 8281 with questions on the submittal. 4. Any waste protruding through the cap must be removed and properly disposed. Cable/wire was observed protruding from the cap across multiple areas of the landfill. 5. Water was observed ponded within the limits of waste during this inspection. Per 15A NCAC 13B .0505 (5)(b) Surface water shall not be impounded over or in waste. 6. Per 15A NCAC 13B .0505 (5)(c), Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. 7. Large rocks and gravel protruding from the cap must be adequately covered or removed. 8. Erosion was observed across the entire area of the project. Adequate erosion control measures shall be utilized to correct current erosion, prevent future erosion and prevent to prevent silt from leaving the site. 15A NCAC 13 B .0505 (4)(a) & (b). 9. It was apparent that the cap had been seeded with grass but, large areas of bare soil remain. The cap shall be reseeded as necessary until stabilization is achieved. 15A NCAC 13B .0505 (6)(a) & (b). 10. Corrective measures are necessary as a result of this inspection and shall be completed within 30 days’ receipt of this report. Trees must be removed from within the edges of waste. What is this and why was it dumped in this location? Needs to be addressed: spread out, and covered or removed.
