The Permit to Operate expired on July 1, 2016. Permit information has been received by the Solid Waste Section - Permitting Branch and is under review. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A North Carolina Administrative Code 13B .0542(f)(1) states: “Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule.” During the inspection, an area of uncovered waste was observed to the southwest of the active working face. Greenway Waste Solutions of Harrisburg, LLC was in violation of 15A NCAC 13B .0542(f)(1) for failing to adequately cover all solid waste with six inches of earthen material at least once weekly. The facility consists of a Construction and Demolition Landfill, a Treatment and Processing facility and a Type 1 Composting facility. 2. The facility is permitted to receive solid waste generated within the following counties: Cabarrus, Mecklenburg, Union, Stanly, Iredell and Rowan. 3. The facility is secured by a locked gate at the facility entrance. 4. Access roads are of all-weather construction. 5. On September 14, 2017, the Solid Waste Section - Permitting Branch received a Permit Modification Amendment. The amendment included an expanded footprint for the existing Phases 1-3 of the CDLF. Please note that no activity (i.e. grading or disposal) can occur in the area of the proposed expanded footprint of the existing Phases 1-3 of the CDLF unless written approval is issued by the Solid Waste Section. Operations Inspection of the CDLF: 6. The facility was working in Phase 3 during the inspection. 7. The working face appeared to be less than ½ acre in size and was well controlled. 8. Observed wood waste consisting of pallets and dimensional cut lumber being stockpiled to be recycle. 9. Observed concrete and asphalt being stockpiled to be ground and reused. 10. Edge of waste markers were being maintained. 11. Windblown waste was well controlled. 12. Good vegetative cover was observed on inactive areas. Operations Inspection of the Type 1 Compost Facility: 13. No unacceptable waste was observed. Operations Inspection of the Treatment and Processing Facility: 14. Only gypsum wallboard/sheetrock is being processed in the recycling facility. No other waste type was observed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Measures need to be taken to ensure that paper from the gypsum wallboard/sheetrock is picked up on a daily basis. Records Review: 1. Reviewed permit, operations plan, soil cover log, training records, quarterly methane monitoring records, semi-annual groundwater and surface water monitoring, random inspection records (3 per day) and compost temperatures. 2. Post inspection research of the quarterly methane monitoring reports found that methane exceedances were documented in MW-1, MW-2 and MW-3 during the April 25, 2017, December 5, 2017 and March 15, 2018 sampling events.
