STATUS OF PERMIT: Original Permit to Construct (PTC) Cell 1, Phases 1-5 issued December 18, 2000 Original Permit to Operate (PTO) Cell 1, Phases 1-5 issued April 16, 2001 Permit Amendment PTC/PTO, Cell 2 Expansion issued December 19, 2006 Permit expired: April 16, 2011 Permit renewal application currently under review PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NONE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: Per 15A NCAC 13B .0566(14), states “Leachate shall be properly managed on site through the use of current best management practices.” Leachate breakout has occurred on the southeastern slope of the landfill and appears to have flowed to the existing sediment trap which has overflowed into the vegetative buffer. ADDITIONAL COMMENTS On March 16, 2016, Liz Patterson and Drew Hammonds to conducted a comprehensive inspection of the Bryant Grading LCID Landfill located at 376 Spence Mill Road, Fuquay-Varina, NC 27526 in Harnett County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. Per 15A NCAC 13B .0566(4) A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency and the permit number. The permit number requirement is not applicable for facilities not requiring an individual permit. Proper signage needs to be posted within 30 days. 3. The facility is properly secured with a locked gate. Personnel are on site during operating hours which are Monday to Friday from 7:30AM to 5:30 PM and Saturday from 8:00AM to 4:00 PM. 4. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. 5. The facility site plan, operations plan, and permit were not reviewed with the site attendant at this inspection. Please have a copy of the facility site plan, operations plan, and permit onsite for future inspections. 6. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 7. Ensure the LCD disposal area is graded accordingly, to include a defined working face and soil cover. Excavation, grading and fill material side slopes shall not exceed three to one (3:1). 8. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Based on observations of the site at the time of this inspection, it appears that uncovered waste was exceeding one acre and had not been covered as required by rule. According to #7 of the approved operations plan, the operator will keep the LCID working face as small as possible with a ½ acre maximum size. All areas of waste that are not part of the working face must be covered within 30 days. 9. A ready supply of soil shall be available for cover material. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Per 15A NCAC 13B .0566(10) Surface water shall be diverted from the working face and shall not be impounded over waste. 11. Ponding of water observed on top of landfill. Grade top of landfill to ensure positive drainage of surface water off the Landfill within 30 days. 12. Permanent waste boundary markers need to be installed within 30 days and maintained around the entire landfill to include active and inactive areas. Waste marker frequency should be placed so that you can see from one to the other. 13. Property lines must be marked within 30 days to ensure that waste is not being dumped into the 100’ buffer for this facility. 14. Erosion on side slopes was noted. Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 days to prevent further erosion. 15. Trees need to be removed from the side slopes of landfill and drainage ditches cleaned out within 30 days. 16. Access roads are of all-weather construction. 17. Digital pictures were taken during the inspection. 18. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
