PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid waste management facility permit shall have two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct must be implemented in accordance with Attachment 2 of this permit. The Permit Approval to Operate must be implemented in accordance with Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. The certified copy of Permit No. 9606-MSWLF-1998 issued October 30, 1997 was presented and recorded in Deed Book 1611, Pages 891-896 by the Wayne County Register of Deeds Office. The certified copy of Permit No. 9601-CDLF-1997 issued August 27, 2012 was presented and recorded in Deed Book 3012, Pages 688-711 by the Wayne County Register of Deeds Office (DIN 18915). 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill and a reference by book and page to the recordation of the permit in accordance with Rule 15A NCAC 13B .0204(e). 5. By beginning construction or receiving waste at the facility the permittee shall be considered to have accepted the terms and conditions of this permit in accordance with Rule 15A NCAC 13B .0203(d). 6. Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules (Rules), 15A NCAC 13B, Article 9 of the Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 3 of 33 Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit, and the approved plan. Should the approved plan and the rules conflict, the Rules shall take precedence unless specifically addressed by a permit condition. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. 8. This permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with applicable statutes and rules. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to, a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 9. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including, but not limited to, approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. From 1974 to 1981, Wayne County operated on this property as a permitted Municipal Solid Waste Landfill (MSWLF) – Unit 1 under Permit No. 9601-MSWLF-1981, with a disposal area of approximately 40 acres. The Unit 1 was closed prior to October 1991 with a 24-inch-thick final soil cover. The MSWLF - Unit 2 encompassing a disposal area of approximately 36.5 acres was operated from 1981 through 1990 and closed with a prescribed final cover in 1998. The landfill Units 1 and 2 were not constructed with a liner below the waste (aka unlined landfill). Records of in-placed waste volumes for the Units 1 and 2 are not available. In 1997, the transition plan for the MSWLF - Unit 2 included a permit modification requesting to construct and operate a Construction and Demolition Debris Landfill (C&DLF) Phase I on top of the closed MSWLF. On December 30, 1997, the Phase I of C&DLF on top of the closed MSWLF was approved to receive waste. 3. In July 1999 to 2002, the Wayne County requested permit modifications to operate Phases I & II of the C&DLF due to increase of waste volume resulting from hurricanes. 4. From 2002 to 2008, the Wayne County continued operation of the C&DLF Phase I. 5. In June 2008, to be in compliance with the North Carolina Solid Waste Management Rule15A NCAC 13B .0547(4), Wayne County requested an approval for continued operations of the C&DLF Phases 1 & 2 and the new facility plan which will develop the landfill facility by seven phases and have a final fill elevation to 280 feet above mean sea level (amsl). 6. In 2016 Wayne County applied for a life-of-site permit for the C&DLF unit on top of the closed unlined MSWLF unit (Unit 2). January 2016 and revised through June 2016. - End of Section – ATTACHMENT 2 CONDITIONS OF PERMIT APPROVAL TO CONSTRUCT PART I: GENERAL FACILITY CONSTRUCTION CONDITIONS 1. This permit approval is for the life-of-site as defined in N.C.G.S. 130A-294(a2). 2. Pursuant to the Rules 15A NCAC 13B .0541(b)(1) or .1621(b)(1), the permittee shall conduct a preconstruction meeting at the landfill facility prior to initiating construction of any phase/cell/sub-cell of the landfill units and must notify the Section at least 10 days prior to the meeting. 3. Pursuant to the Rules 15A NCAC 13B .0542(i)(2) or .1626(5), open burning solid waste without prior approval is prohibited at this landfill facility. 4. This facility shall conform to the specific conditions set forth in this permit and the provisions of Rules 15A NCAC 13B .0534(b)(2) or .1604(b)(2). EROSION AND SEDIMENTATION CONTROL REQUIREMENTS Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 10 of 33 5. All required sedimentation and erosion control measures must be installed and operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill units during the service life of the facility. 6. All earth disturbing activities must be conducted in accordance with the approved Erosion and Sediment Control Plan, the Sedimentation Pollution Control Act of 1973 (15A NCAC 4), and consistent with any other local, state or federal requirements. 7. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. 8. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The Section must be notified of any sedimentation and erosion control plan modifications. GEOLOGIC, GROUND WATER AND MONITORING REQUIREMENTS 9. Prior to construction of the sub-cells or cell(s) within the phase, all piezometers, borings, and groundwater monitoring wells within the footprint must be properly abandoned in accordance with 15A NCAC 2C .0113 (b)(1), entitled “Abandonment of Wells.” 10. In areas where soil is to be undercut, abandoned piezometers, monitoring wells and borings must not be grouted to pre-grade land surface, but to the proposed base grade surface to prevent having to cut excess grout and possibly damage the wells. 11. A Licensed Geologist must report any pertinent geological feature(s) exposed during phase or cell excavation. Prior to placing any landfill liner, the geologist must submit to the Section Hydrogeologist a written report that includes an accurate description of the exposed geological feature(s) and effect of the geological feature(s) on the design, construction, and operation of the cell, phase, or unit. 12. A Licensed Geologist must supervise installation of groundwater monitoring wells and surface water sampling stations. 13. Any modification to the approved water quality monitoring, sampling, and analysis plan must be submitted to the Section Hydrogeologist for review. 14. The permittee must provide a plan sheet-sized, scaled topographical map, showing the location and identification of new, existing, and abandoned wells and piezometers after installation of groundwater monitoring wells. 16. Within thirty (30) days of the completed permanent abandonment of a ground-water monitoring well, the well abandonment record (GW-30 form) and any additional information included in the abandonment record) must be submitted to the Section. The well abandonment records must be submitted to the Solid Waste Section in accordance with 15A NCAC 2C .0114(b) and be certified by a Licensed Geologist. 17. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT CONSTRUCTION CONDITIONS Wayne County MSWLF, 9606-MSWLF-1998 (UNIT 3) 1. This permit approves the plans that define the comprehensive development of the MSWLF unit encompassing 65-acre waste footprint and consisting of eight (8)-phased developments – Phases 1 through 8 with total gross capacity of 5,365,695 cubic yards (CY), which is measured from the top of the protective cover to the top of final cover at the elevations ranging from 244 feet above mean sea level (amsl) with the maximum side slopes of 3 (horizontal) to 1 (vertical) as shown on the Drawing No. F6/Sheet No. 8 of 8 (DIN 27286). 2. Pursuant to Rule 15A NCAC 13B .0201(d)(1), this permit approves the construction of Phases 4, 5, 6, 7, and 8, vertical expansions over the existing Phases 1 through 3 of the MSWLF unit as shown on Drawing No. F1/ Sheet No. 3 of 8 through Drawing No. F6/ Sheet No. 8 of 8 in the approved plans (DIN 27286). Construction of Phases 4 through 8 shall only be in accordance with the approved plans and drawings listed in Part II, Attachment 1 of this permit and the requirements stipulated in Rules 15A NCAC 13B Section .1600. 3. Pursuant to N.C.G.S. 130A-295.8(b)(1), the design or construction of any future phases – Phases 4, 5, 6, 7 or 8 of this MSWLF unit resulting in any change to the approved engineering plan identified in the in Part II, Attachment 1 of this permit requires written approval of the Section. The permittee shall submit the Section a major permit modification application to the approved permit to construct application, which shall be prepared according to Rule 15A NCAC 13B .1617 for review and approval before construction activities commence. PART III: CONSTRUCTION AND DEMOLITION DEBRIS LANDFILL UNIT CONSTRUCTION CONDITIONS Wayne County C&DLF, 9601-CDLF-1997 (a landfill unit on top of a closed unlined MSWLF – Unit 2) 1. This permit approves the plans that define the comprehensive development of the C&DLF unit encompassing the 40-acre waste footprint over the closed unlined MSWLF unit (Unit 2) and consisting of seven (7)-phased developments – Phases 1 through 7 with a total gross capacity of 2,736,883 CY, which is measured from the bottom of C&D waste (the top of the cover system of the closed unlined MSWLF - Unit 2) through the top of final cover of the C&DLF at an elevation of 280 feet amsl with the final fill of 3 (horizontal) to 1 (vertical) side slopes Drawing No. F6/Sheet No. 8 of 8 (DIN 27286). 2. Pursuant to the Rule 15A NCAC 13B .0201(d)(1), this permit approves the vertical expansions of Phases 3, 4, 5, 6, and 7 over the Phases 1 and 2 of the MSWLF unit as shown on Drawing No. F1/ Sheet No. 3 of 8 through Drawing No. F6/ Sheet No. 8 of 8 in the approved plans (DIN 27286). Construction of Phases 3 through 8 shall only be in accordance with the approved plans and drawings listed in Part III, Attachment 1 of this permit and the requirements stipulated in Rules 15A NCAC 13B Section .0500. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 13 of 33 3. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT UNIT (S) Not Applicable. - End of Section- ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE PART I: GENERAL FACILITY OPERATION CONDITIONS 1. This permit approval to operate for a. The lined MSWLF unit (Unit 3) is for the life-of-site as defined in N.C.G.S. 130A-294(a2), which shall expire May 17, 2059. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 14 of 33 b. The C&DLF unit, on top of the closed unlined MSWLF (unit 2), is for the life-of- site as defined in N.C.G.S. 130A-294(a2) which shall expire April 30, 2041. 2. Pursuant to N.C.G.S. 130A-309.09A(g), the permittee must not knowingly dispose of municipal solid wastes that is generated within the boundaries of a unit of local government that by ordinance: a. Prohibits generators or collectors of solid waste from disposing of that type or form of solid waste. b. Requires generators or collectors of solid waste to recycle that type or form of solid waste. 3. This facility is permitted to receive non-hazardous solid waste, as defined in N.C.G.S. 130-290 (a)(35) that is generated within Wayne County, except where prohibited by North Carolina General Statutes Article 9 of Chapter 130A and the 15A NCAC 13B rules. 4. The facility operator must complete an approved operator training course in compliance with N.C.G.S. 130A-309.25. A responsible individual certified in landfill operations must be on-site during all operating hours of the facility at all times while open for public use. 5. The permittee must actively employ a training and screening program at the facility prepared in accordance with applicable Rules, N.C.G.S. 130A-295.6(g), and the approved Operations Plan (DIN 27286) for detecting and preventing the disposal of excluded or unauthorized wastes. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures. b. Records of any inspections. c. Training of personnel to recognize hazardous, liquid, and other excluded waste types. d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes. 6. Open burning of solid waste is prohibited. Fires must be reported to the regional Environmental Senior Specialist with 24 hours or the occurrence, followed by a written Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 15 of 33 notification within 15 calendar days of the occurrence according to the Operations Plan (DIN 27286) and the 15A NCAC 13B rules. 7. Closure and post-closure activities for any landfill unit at this facility must be conducted in accordance with the approved Closure and Post-Closure Plans (DIN 27286) and applicable Rules 15A NCAC 13B .0543 or .1627 & .1629. 8. The final closure plan must be submitted for approval at least ninety (90) days prior to closure or partial closure of any landfill unit. The plan must include all steps and measures necessary to close and maintain the landfill unit in accordance with all rules in effect at that time. At a minimum, the plan must address the following: a. Design of a final cover system in accordance with Rules 15A NCAC 13B .0543, .1627, or the solid waste management rules in effect at the time of closure. b. Construction and maintenance/operation of the final cover system and erosion control structures. c. Surface water, ground water, and explosive gas monitoring. 9. Pursuant to N.C.G.S. 130A-295.2(f), the permittee must continuously maintain the required financial assurance for the duration of the facility. The permittee must annually update and adjust closure and post-closure cost estimates and costs for potential assessment and corrective action at the landfill facility for inflation according to Rule 15A NCAC 13B .1628 and N.C.G.S. 130A-295.2(h). 10. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. 11. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq. and rules promulgated under 15A NCAC 4. All required sedimentation and erosion control measures must be installed and operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill unit during the service life of the facility. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The Section must be notified of any sedimentation and erosion control plan modifications. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 16 of 33 12. The permittee must well maintain permanent physical markers that accurately identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill facility. 13. In accordance with N.C.G.S. 130A-295.6 the sanitary landfill unit may use alternative daily cover (ADC) as the periodical cover material in compliance with the requirement stated in Rule 15A NCAC 13B .1626(2), if the ADC and pertinent applications have been previously approved for use at other sanitary landfills in North Carolina. The Section maintains a list of approved alternative cover material and its appropriate use, which may be referred to, but is not required to be, in determining ADC types and uses: a. The use of ADC that does not meet the requirements stated in N.C.G.S. 130A- 295.6 requires approval, prior to implementation, by the Section. Requests for ADC approval must include a plan detailing the comprehensive use and a demonstration of the effectiveness of the alternative cover, developed according to Section guidelines. Plans that are approved by the Section will be incorporated into, and made a part of, the approved documents listed in Attachment 1. b. ADC and pertinent applications of ADC are described in the approved Operations Plan (DIN 27286). The lined MSWLF unit is approved to use the following ADCs: automotive shredder residues, combustion residual/ash, C&D fines, petroleum contaminated soils, spray-applied mortar coating, foam coating, foundry sand, soil/mulch mixture, and synthetic tarps. 14. The permittee must maintain records for all solid waste materials accepted and used as ADC. The records must include: the date of receipt, weight of material, general description of the material, identity of the generator and transporter, and county of origin. Such records must be made available to the Section upon request. The application of ADC materials in excess of normal application of daily cover of the material shall constitute disposal. ENVIRONMENTAL MEDIA MONITORING AND REPORTING REQUIREMENTS General Conditions 15. Groundwater, surface water, and landfill gas monitoring locations must be established and monitored as identified in the approved plans (DIN 1068114, 26387, 27648 & 26388). 16. The permittee must implement the following permit conditions: a. The permittee must obtain approval from the Section for the design, installation, and abandonment of any groundwater or landfill gas monitoring well. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 17 of 33 b. Each groundwater and landfill gas monitoring well must be surveyed in accordance with Rules 15A NCAC 13B .0544(b)(1)(F) or .1632(d)(1). c. Each groundwater and landfill gas monitoring well must have an identification plate permanently attached to the well, in accordance with 15A NCAC 2C .0108(o). d. The permittee must maintain the following documentations in the facility operating record in accordance with Rules 15A NCAC 13B .0542(n) or .1626(10): i) The report for each monitoring event of the groundwater, surface water, and landfill gas and pertinent analytical data. ii) Documents of well completion, development details, repair, abandonment, and all other pertinent activities associated with each groundwater and landfill gas monitoring well monitoring location. e. A readily accessible, unobstructed path must be maintained so that groundwater and landfill gas monitoring wells, and surface water sampling locations are accessible using four-wheel drive vehicles. Water Quality Monitoring and Reporting Conditions 17. Groundwater and surface water monitoring at this landfill facility must be conducted in compliance with Rules15A NCAC 13B .0544 & .0545, .1630 through .1637, .0602, and the approved monitoring plans (DIN 26387, 27648, 1068114 & 1068109). Any proposed modification to an approved plan must be submitted to the Section and approved prior to implementation. 18. Groundwater quality is subject to 15A NCAC 2L – Groundwater Classifications Standards and the Groundwater Protection Standards (GPS) established under Rules 15A NCAC 13B .0545(b) and .1634(i). Surface water is subject to 15A NCAC 2B – Surface Water and Wetlands Standards. 19. Unless otherwise specified by the Section, surface water locations, and groundwater monitoring wells must be sampled at least semi-annually in accordance with applicable Rules, the approved monitoring plans (DIN 26387, 27648, 1068114 & 1068109), and the current policies and guidelines of the Section in effect at the time of sampling. 20. Monitoring reports of the analytical results for groundwater, surface water sampling events must be submitted to the Section within 120 days of the sample collection date. Analytical laboratory data must be submitted in electronic format (pdf) and in a Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 18 of 33 spreadsheet format in an Electronic Data Deliverable (EDD) Template. All monitoring reports must contain: a. A potentiometric surface map for the current sampling event. b. Analytical laboratory reports and summary tables. c. A completed Solid Waste Environmental Monitoring Data Form. d. Laboratory data submitted in accordance with the EDD Template. 21. The permittee must implement the following permit conditions: a. For a MSWLF unit. The four independent samples which comprise the initial baseline sampling event must be collected from each new installed groundwater monitoring well in accordance with 15A NCAC 13B. 1633(b). b. For a C&DLF unit. A baseline sampling event for background water quality shall be completely performed from each new installed groundwater monitoring well in accordance with 15A NCAC 13B. 0544(b)(1)(D). c. The report including analytical data must meet the requirements stated in the Permit Condition No. 20 of Part I, Attachment 3 and be submitted to the Section for review. Landfill Gas Monitoring, Management, and Reporting Conditions 22. A landfill gas monitoring event must include monitoring for all explosive gases including monitoring hydrogen sulfide at and around the C&DLF unit and must be conducted at the facility including interior monitoring of on-site buildings in accordance with the approved landfill gas monitoring plan (DIN 26388) and Rules 15A NCAC 13B .0544(d) and .1626(4). Any proposed modification to an approved plan must be submitted to the Section Hydrogeologist and approved prior to implementation. 23. The permittee must sample landfill gas quarterly unless otherwise required for corrective action or specified by the Section. 24. The permittee is responsible to employ properly trained personnel to conduct gas monitoring. 25. Landfill gas monitoring reports must be placed to the facility’s operating record, according to Rules 15A NCAC 13B .0542(n) and .1626(10), within 7 days of the monitoring event, and must include a description of the monitoring method used, the Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 19 of 33 sampling results of each well and onsite buildings in percent of the lower explosive limit (LEL), date of monitoring, weather conditions, calibration report, and signature of the sampling personnel. 26. The permittee must comply with the requirements of the rules if a. At the MSWLF or C&DLF units, landfill gas monitoring reveals detections of methane greater than 25 percent of the LEL in onsite buildings, or detections of LEL at the compliance boundary, or the stabilized hydrogen sulfide concentration is greater than 20 parts per million (ppm), the permittee must comply with the requirements of Rules 15A NCAC 13B .0544(d) or .1626(4). b. At the C&DLF unit, the stabilized hydrogen sulfide concentration is greater than 20 parts per million (ppm), the permittee must comply with the requirements of Rule 15A NCAC 13B .0544(d). 27. The permittee is responsible to employ or contract with properly trained personnel to conduct landfill gas monitoring and operate, inspect, and maintain the constructed landfill gas collection and control system (LFGCCs) and landfill gas to energy system (LFGTE) according to the permit conditions and written protocols for monitoring, inspection & maintenance stated in the approved plans and amendments (DIN 17085). 28. The permittee must maintain the valid permit (s) from the North Carolina Division of Air Quality and comply with any local, state or federal regulations including routinely reporting requirements to operate the existing LFGCCs and LFGTE. RECORDING AND RECORDKEEPING 29. Copies of this permit, the approved plans, and all records required to be maintained by the permittee must be maintained at the facility and made available to the Section upon request during normal business hours according to Rules 15A NCAC 13B .0542(n) and .1626(10), and the approved plan (DIN 27286). 30. The permittee must maintain records of the following. Scales must be used to weigh the amount of waste received. The daily reports are to be summarized into a monthly report for use in the required annual reports. a. The amount of all accepted solid waste materials as (i) MSW (ii) C&D wastes, (iii) material used as alternate periodic cover, and (iv) recyclable material. b. Daily records of waste received, and origins of the loads. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 20 of 33 31. On or before August 1 annually, the permittee must submit an annual facility report to the Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received and landfilled in tons and be compiled: i) On a monthly basis. ii) By county, city or transfer station of origin. iii) By specific waste type. iv) By disposal location within the facility. v) By diversion to alternative management facilities. c. A measurement of volume utilized in the landfill cells must be performed during the second quarter of the calendar year. The date and volumes, in cubic yards, must be included in the report. d. The amount of waste, in tons from scale records, disposed in landfill cells from December 30, 1997 through the date of the annual volume survey must be included in the report. e. The tons of waste recycled, recovered or diverted from disposal including a description of how and where the material was ultimately managed, as applicable, must be included in the report. f. The completed report must be forwarded to the regional Environmental Senior Specialist for the facility by the date due on the prescribed annual facility report form. g. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the regional Environmental Senior Specialist by the date due on the prescribed annual facility report form. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT(S) Wayne County MSWLF, 9606-MSWLF-1998 (UNIT 3) 1. This permit approves the continued operation of the lined MSWLF unit (Unit 3), as well as the onsite environmental management and protection facilities as described in the approved plans (DIN 27286). Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 21 of 33 2. The lined MSWLF unit (Unit 3) that encompasses 65-acre waste footprint and consists of eight (8)-phased developments – Phases 1 through 8 has the approved total gross capacity of 5,365,695 cubic yards (CY), which is measured from the top of the protective cover to the top of final cover at the elevations up to 244 feet above mean sea level (amsl) with the maximum side slopes of 3 (horizontal) to 1 (vertical) as shown on the Drawing No. F6/Sheet No. 8 of 8 (DIN 27286). Operations of Phases 1 through 8of the MSWLF unit shall only be in accordance with the approved plans and drawings listed in Part II, Attachment 1 of this permit, permit conditions, and the requirements stipulated in Rules 15A NCAC 13B Section .1600. The lined MSWLF unit must not be accepted the following wastes, at a minimum, for disposal: hazardous waste, yard trash, white goods, tires, recyclable rigid plastic bottles, wooden pallets, motor vehicle oil filters, liquid wastes, regulated medical waste, sharps not properly packaged, PCB waste as defined in 40 CFR 761, and wastes banned from disposal in North Carolina by N.C.G.S. 130A-309.10(f). 4. Spoiled food, animal carcasses, slaughterhouse or hatchery waste, or other animal waste received must be immediately buried and covered with a layer of soil followed by non- putrescible municipal solid waste in accordance with Rule 15 NCAC 13B .1626(1)(c). 5. Regulated asbestos-containing material as defined in 40 CFR 61 must be managed in accordance with 40 CFR 61. Disposal of asbestos waste must be in accordance with Rule 15A NCAC 13B .1626(1)(d). 6. The lined MSWLF unit is permitted to co-dispose of wastewater treatment sludge generated within the facility's approved service area as defined in the Permit Condition Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 22 of 33 No. 3, Part I Attachment 3 of this permit, subject to the terms and procedures of the approved plan and Rule 15A NCAC 13B .1626(1)(e). 7. The use of leachate recirculation at the lined MSWLF unit is NOT APPROVED. The use of leachate recirculation as a leachate management tool requires approval by the Section prior to implementation. Requests for leachate recirculation approval must include a comprehensive management plan. 8. The leachate collection and removal system (LCRs) including the on-site leachate lagoon must be periodically cleaned and maintained in accordance with Rules 15A NCAC 13B .1626(12)(a) & 1680, N.C.G.S. 130A-295.6(h)(3), and the approved Leachate Maintenance Plan (DIN 27286). Remote camera inspections of leachate lines shall occur at least once every five years. The permittee must maintain documentations of inspections, cleaning, and monitoring of the LCR piping, sump risers and apparatus, and the on-site leachate lagoon in the operating records at the facility and provided to the Section upon request. 9. Untreated leachate must be sampled and analyzed at least semi-annually concurrently with the groundwater water and surface water sampling. The leachate must be analyzed for all Appendix I constituents, pH, specific conductance, BOD, COD, nitrates, sulfates, and phosphates. Test results must be submitted to the Section along with groundwater and surface water test results. In the event leachate is recirculated, additional leachate sampling may be required. PART III: CONSTRUCTION AND DEMOLITION DEBRIS LANDFILL UNIT(S) Wayne County C&DLF, 9601-CDLF-1997 (a landfill unit on top of a closed unlined MSWLF – Unit 2) 1. This Permit Approval to Operate approves the continued operation of the C&DLF unit on top of the closed unlined MSWLF unit- Unit 2 and the onsite environmental management and protection facilities as described in the approved plan (DIN 27286). 2. The C&DLF unit encompassing the 40-acre waste footprint over the closed unlined MSWLF unit (Unit 2) and consisting of seven (7)-phased developments – Phases 1 through 7 has the approved total gross capacity of 2,736,883 CY, which is measured from the bottom of C&D waste (the top of the cover system of the closed unlined MSWLF - Unit 2) through the top of final cover of the C&DLF at an elevation of 280 feet amsl with the final fill of 3 (horizontal) to 1 (vertical) side slopes Drawing No. F6/Sheet No. 8 of 8 (DIN 27286). Operations of Phases 1 through 7 of the C&DLF unit shall only be in accordance with the approved plans and drawings listed in Part III, Attachment 1 of this permit, Permit Conditions, and the requirements stipulated in Rule Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 23 of 33 15A NCAC 13B .0542. The C&DLF unit is permitted to receive the following waste types for disposal: a. “Construction or demolition debris” as defined in N.C.G.S. 130A-290(a)(4) means solid waste resulting solely from construction, remodeling, repair or demolition operations on pavement, buildings, or other structures, but does not include inert debris, land-clearing debris or yard debris. C&D waste does not include municipal and industrial wastes that may be generated by the on-going operations at buildings or structures. b. “Inert debris” as defined in N.C.G.S. 130A-290(a)(14) means solid waste that consists solely of material such as concrete, brick, concrete block, uncontaminated soil, rock, and gravel. c. “Land-clearing debris” as defined in N.C.G.S. 130A-290(a)(15) means solid waste that is generated solely from land-clearing activities, such as stumps and tree trunks. d. “Asphalt” in accordance with N.C.G.S. 130-294(m). e. Solid waste that is generated by mobile or modular home manufacturers and asphalt shingle manufacturers in Wayne County. The waste must be source separated at the manufacturing site and must exclude municipal solid waste, hazardous wastes, and other wastes prohibited from disposal at this landfill. It must be transported to the landfill in a shipment or container that consists solely of the separated waste to be disposed. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 24 of 33 4. Those wastes listed in Rule 15A NCAC 13B .0542(e) must not be accepted for disposal including, but not limited to, hazardous waste, municipal solid waste, liquid waste, commercial or industrial wastes, and yard trash. 5. Regulated asbestos-containing material as defined in 40 CFR 61 must be managed in accordance with 40 CFR 61. Disposal of asbestos waste must be in accordance with Rule 15A NCAC 13B .0542(c)(2) and the approved Operations Plan (DIN 27286). 6. Wastewater treatment sludge is not approved for disposal according to Rule 15A NCAC 13B .0542(d). Wastewater treatment sludge may be accepted, with the approval of the Section, for utilization as a soil conditioner and incorporated into or applied onto the vegetative growth layer. The wastewater treatment sludge must neither be applied at greater than agronomic rates nor to a depth greater than six inches. 7. Wooden pallets as defined in N.C.G.S. 130A-290(44a) are not approved for disposal except for those pallets generated in C&D activities. 8. “Yard waste” as defined in Rule 15A NCAC 13B .0101(56) meaning “Yard Trash” and “Land-Clearing Debris” as defined in N.C.G.S. 130A-290, including stumps, limbs, leaves, grass, and untreated wood may be accepted and managed in the Land Clearing and Inert Debris Landfill (LCIDLF) or Passive Compost Area as described in the approved plan (DIN 19483 and 27286) and the Permit Conditions in Parts V or VII, Attachment 3 of this permit. GROUNDWATER CORRECTIVE ACTION PROGRAM SPECIFIC CONDITIONS 9. Pursuant to Rule 15A NCAC 13B .1637, the permittee must implement a corrective action program to remediate elevated constituents in groundwater in accordance with the approved Corrective Action Plan (CAP) (DIN 8821) and CAP amendment (DIN 1068109). The approved corrective action program consists of Monitored Natural Attenuation (MNA) coupled with phytoremediation, an active landfill gas collection and control system (LFGCCs), institutional controls, and capping for the source control. Any proposed modifications to the approved CAP must be submitted to the Section and approved prior to implementation. 10. The monitoring network for the corrective action program must be consistent with that described in the approved sampling plan (DIN 1068114) and CAP amendment (DIN 1068109) and any future amendment to the approved plans, unless otherwise specified by the Section. Sampling frequency and constituents to be analyzed must be conducted in accordance with the approved plan. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 25 of 33 11. An EPA approved MNA screening model is required at least annually to simulate the groundwater remediation at the facility and determine the mass flux and mass balance. The model must be submitted annually with a monitoring report. 12. Pursuant to Rule 15A NCAC 13B .0547(4)(c), the permittee must provide a Corrective Action Evaluation Report (CAER) to describe of the performance and effectiveness of the implemented corrective action program, including a technical evaluation of MNA and Phytoremediation as remedies for designated area inside the facility. The subsequent CAERs are required every 5 (five) years until the Permit Condition No. 17, Part III, Attachment III of this permit is achieved unless otherwise specified by the Section. Failure to comply may result in compliance action or permit revocation according to Rule 15A NCAC 13B .0703 and N.C.G.S. 130A-23. 13. If the objectives of the corrective action program are not being met, as specified in the approved CAP, Rules, or as determined by the Section, the permittee must immediately implement the Contingency Plan in the approved CAP and/or the CAP amendments. 14. If constituents in groundwater migrate beyond the landfill property boundary, or it is suspected to have occurred based on sampling results near the property boundary, the permittee must immediately notify all persons in writing who own land or reside on land that directly overlies any part of the contaminant plume with details of the migration. The permittee must mitigate further releases to the groundwater, reduce threats to human health and the environment, and immediately implement the Contingency Plan in the approved CAP and the CAP amendments. 15. If the corrective action program is modified to include an active groundwater treatment system: a. The permittee must operate the groundwater treatment system in a manner that will prevent spills, releases or other adverse effects to human health and the environment. b. The permittee must maintain an inspection schedule for the inspection of all parts of the groundwater treatment system as outlined in the approved CAP and CAP amendments. c. The permittee must train all personnel operating the groundwater treatment system as outlined in the approved CAP and CAP amendments. d. The permittee must sample the groundwater in the impacted aquifer, the groundwater as it enters and exits the groundwater treatment system and measure Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 26 of 33 the volume and rate of flow of groundwater through the groundwater treatment system as indicated in the approved CAP and its addendum. The data must be submitted to the Section with a monitoring report. 16. Institutional controls (deed recordation, land and groundwater use restrictions) must be implemented as part of a groundwater treatment system pursuant to N.C.G.S. 143B-279.9 and 143B-279.10. The land and groundwater use restrictions will be imposed on the permitted facility and any buffer property that has been acquired to reduce or eliminate the danger to public health or the environment posed by the presence of contamination on the property. The permittee must submit to the Section, within 180 days of notified to do so, a survey plat, in accordance with the requirements of N.C.G.S. 143B-279.10, and as directed by the Section. 17. The permittee must continue to operate the corrective action program until the 15A NCAC 2L Groundwater standards and the GPS have been met at all points within the plume of contamination that lie beyond the relevant point of compliance for three (3) consecutive year, in accordance with Rule 15A NCAC 13B .1637. POST-CLOSURE REQUIREMENTS FOR THE CLOSED UNLINED MSWLF UNITS – Wayne County Landfill, 9601-MSWLF-1981 (UNITS 1 & 2) 18. The closed unlined MSWLF units – Unit 1 and Unit 2 (below the active C&DLF unit) were closed with the final cover systems in 1991 and 1998, respectively. Post-closure maintenance and monitoring of the landfill unit must be conducted in accordance with approved documents, Part III, Attachment 1 of this permit and the North Carolina Solid Waste Management Rules 15A NCAC 13B. 19. The permittee must maintain the integrity and effectiveness of the cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, leachate outbreaks, or other events; preventing surface water from impounding over waste; and preventing run-on and run-off from eroding or otherwise damaging the cap system. As issues are resolved, notations should be documented and placed in the operating records. 20. The permittee must conduct routine inspections at the closed MSWLF units and the active C&DLF unit and implement the measures to prevent a leachate outbreak. In the event of any leachate outbreak is observed, the permittee must notify the Section and implement the corrective actions including environmental media sampling described in the approved plan (DIN 27286). Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 27 of 33 21. Post-closure use of the property is subject to review and approval by the Section and must not disturb the integrity of the cap system, or the function of the monitoring systems. The Section may approve any other disturbance if the permittee demonstrates that disturbance of the cap system, including any removal of waste, will not increase the potential threat to human health or the environment according to Rule 15A NCAC 13B. 1629(c)(3). 22. Any new proposal of lateral or vertical expansions to the closed unlined MSWLF units would be considered a new landfill according to N.C.G.S. 130A-295.8(b). PART IV: INDUSTRIAL LANDFILL UNIT(S) Not Applicable. PART V: LAND CLEARING AND INERT DEBRIS LANDFILL UNIT(S) 1. This permit approves the construction and operation of the Land Clearing and Inert Debris Landfill (LCIDLF) consisting of the waste footprints less than two (2) acres in size and having the final grade elevation at 195 feet amsl with 3 (horizontal) to 1 (vertical) side slopes as shown in Drawing No. LCID1/Sheet No. 1 of 1 of the approved plan (DIN 27286). The following table lists the dimensions and details for the LCIDLF. The permittee must operate this LCIDLF according to the approved plan (DIN 27286) and Rule 15A NCAC 13B .0566. Any revisions of the approved plan must be submitted for review and approval by the Section. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 28 of 33 3. This facility is permitted to disposal of land clearing waste, yard trash, untreated and unpainted wood, and inert debris such as rock, brick, concrete, concrete block, and uncontaminated soil which are generated within the Wayne County, North Carolina. 4. The approved disposal rate of the LCIDLF is approximately 1,040 CY annually (or 520 tons per year) in year 2012, with an increasing rate of 0.83% annually, in accordance with the approved plans. 5. Excavation, grading and fill material side slopes of the LCIDLF must not exceed a ratio of three feet to one foot [3 (horizontal):1 (vertical)]. 6. The permittee must place waste at the landfill cell above the seasonal high water table. 7. Groundwater and surface water quality at this facility is subject to the classification and remedial action provisions of 15 NCAC 2L and 2C, respectively. PART VI: TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) Not Applicable. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT UNIT (S) GENERAL CONDITIONS 1. The landfill facility may accept “recovered material” or “recyclable material” as defined in N.C.G.S. 130A-294(a)(24) and (26), respectively that are generated within Wayne County must be processed and utilized at the landfill facility or transferred to or disposed of at the off-site facilities described in the approved plans (DIN 19483 and 27286). 2. Upon completion of randomly waste screening according to the approved plan, the permittee shall manage the acceptable recovered or recyclable material as a valuable commodity in a manner consistent with the desired use or end use, which shall be temporarily stockpiled in the designated area as shown on Drawing No. F1/Sheet No. 3 of 8. The permittee must operate and manage received recyclables or recovered materials at this facility according to the requirements set forth in N.C.G.S. 130A-309.05(c) and the approved plan (DIN 19483 and 27286). 3. Seventy-five present (75%), by weight, of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, must be removed from the facility through sale, use, or reuse by December 31 of the same year. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 29 of 33 4. Wastes received and product stored shall be maintained in reasonably sized piles with adequate fire breaks and lanes in accordance with the approved operational plans and the pertinent rules. 5. Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste is deemed to be leachate and shall be contained on-site or properly treated prior to discharge. 6. These areas shall be operated and maintained with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. 7. These areas shall be operated and maintained in a manner so as to minimize odors, prevent the creation of a nuisance, potential health hazard, or a potential fire hazard. 8. Effective vector control measures shall be applied as necessary to control flies, rodents, insects, and vermin. 9. Records shall be kept at the facility in accordance with the approved plan (DIN 19483 and 27286). OPERATIONAL CONDITIONS – CONVENIENCE CENTER 10. The Convenience Center including the Recycling Area that is located on the south side of the landfill facility and next to the scale house is permitted to receive/collect, separate, and/or bail the following wastes, recyclables, and special wastes: a. Small-load household garbage. b. Recyclables including used motor oil, oil filters, antifreeze, papers – newspaper, phone books, & magazines, aluminum cans, steel cans, PET plastic, cardboard boxes, electronic wastes and lead-acid batteries. c. Land clearing debris, green wastes, and clean wood waste. 11. After being weighed, the received MSW and/or non-conforming recyclables that are permitted for disposal must be transported and subsequently disposed of at the MSWLF unit in this permit; the collected recyclables that are permitted to be sorted, separated, processed/bailed, and temporarily stored inside the Recycling Area pending sale and shipment to off-site recycling facilities must be operated and managed according to the approved plans (DIN 27286). No mixing or comingling wastes is allowed inside the Convenience Center. A visible label, marking, or sign for each collected recyclable must be posted on the exterior surface of container or placed on a post next to the container or area. 13. Proper aisle spaces between waste containers, i.e., drums or roll-off boxes, must always be maintained for inspection of leakage, for firefighting, and for container removal. 14. Discarded electronic equipment including televisions and computers as defined in N.C.G.S. 130A-309.131 must be stored in covered container (s) or structures. 15. The area for collection and temporary storage of used motor oil, as defined in N.C.G.S. 130A-290.(b)(5), is a public used oil collection center as defined in N.C.G.S. 130A- 290.(b)(1); therefore, the permittee must operate and manage collected used oil in accordance with N.C.G.S. 130A-309.15 & 130A-309.20. Used oil shall be temporarily stored in an above-ground container with a secondary containment. OPERATIONAL CONDITIONS – WHITE GOODS/ SCRAP METAL COLLECTION AREA 16. The area is permitted to receive and temporarily store white goods as defined in N.C.G.S.130A-290(a)(44) and scrap metal in a container or containers at the designated area. The permittee must manage the white goods in accordance with the Operations Plan (DIN 27286) and all applicable statutes and rules of the State of North Carolina. 17. Pursuant to N.C.G.S. 130A-309.81, the permittee must ensure that chlorofluorocarbon refrigerants (Freon) inside the white goods are properly removed weekly by a certified employee or contractor and stored at the designated location prior to transporting off-site to a recycling facility. OPERATIONAL CONDITIONS – SCRAP TIRE COLLECTION AREA 18. The tire collection area that consists of two tractor trailers and is located near scale house is permitted to accept scrap tires generated by Wayne County residents. 19. The permittee must operate and manage the scrap tire collection area in accordance with Rule 15A NCAC 13B .1107 and the approved Operations Plan (DIN 27286). The collected tires must be sent to an off-site permitted tire recycling or disposal facility. OPERATIONAL CONDITIONS – TEAR-OFF ASPHAT SHINGLE COLLECTION AREA 20. The facility is permitted to operate an asphalt shingles recycling unit according to the approved Operations Plan for Sorting Tear-off Asphalt Shingles for Recycling (DIN 19483 and 27286). Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 31 of 33 21. The permittee must conduct random waste screening processes according to the approved Operations Plan (DIN 19483 and 27286) to ensure that prohibited wastes are identified and removed to designated areas for proper disposal at the end of each working day. 22. The permittee must ensure the collected tear-off asphalt shingles are stored at an area adjacent to working face of the C&DLF unit as shown on the Drawing No. F1/Sheet No. 3 of 8 (DIN 27286). Grinding of asphalt shingle is prohibited at this unit. 23. The copy of completed Shingle Supplier Certification Form and supporting documents must be placed in the operating record. OPERATIONAL CONDITIONS – MOBILE HOME DECONSTRUCTION AREA 24. Mobile homes as defined in N.C.G.S. 105-164.3(20) and generated from mobile or modular home manufacturers located in Wayne County will be accepted for deconstruction. 25. The permittee must implement the approved plan (DIN 27286) to temporarily store mobile homes, stockpile recyclable materials, and conduct deconstruction activities. The storage and deconstruction activities shall take place only in the designated areas, which shall be in graded areas adjacent to the C&DLF unit. 26. Regulated asbestos-containing material as defined in 40 CFR 61 must be managed in accordance with 40 CFR 61. The permittee must follow the approved plan to properly remove asbestos-containing material from a mobile home. Disposal of asbestos waste must be in accordance with Rule 15A NCAC 13B .0542 (c). 27. White goods, as defined in N.C.G.S. 130A-290(a)(44), which are within mobile homes to be deconstructed, must be properly removed to the White Goods and Scrap Metal Handling Area prior to deconstruction activities. White goods must be managed in accordance with all federal, state, and local applicable statutes and rules and the Permit Condition No. 19, Part VII, Attachment 3 of this permit. 28. Received mobile homes must be deconstructed within 45 days from acceptance into the deconstruction area. The date of receipt at the landfill shall be posted on the mobile home or its frame. 29. All material not planned for recycling must be placed in an approved disposal unit before the end of the day in which deconstruction takes place. Facility Permit Nos. 9601-CDLF-1997 & 9606-MSWLF-1998 Permit Approval to Construct & Operate Wayne County Landfill Facility Issuance Date: April 9, 2018 DIN 27287 Page 32 of 33 30. Recyclable materials may be stockpiled at the mobile home deconstruction area for no more than 45 days from the date of deconstruction. OPERATIONAL CONDITIONS – PASSIVE COMPOST AREA 31. A passive composting unit that encompasses approximately 0.94 acres is permitted to be operated at a former borrow pit which is located at least 50-feet away from the LCIDLF disposal area and drainage features. The maximum storage capacity of the wastes and compost product at this area is 3,500 ton per year. 32. The following wastes that are generated from Wayne County are permitted to be accepted and collected in containers at the Convenience Center initially. Once the container is full, the containerized wastes will be transported through the scale house to the designated area for passive compost. a. Yard waste as defined in Rule 15A NCAC 13B .0101(56). b. Untreated, unpainted, and uncontaminated wood. c. Land clearing wastes N.C.G.S 130A-290(a)(15). 33. High carbon-nitrogen ratio materials or green wastes (such as grass clipping and leaves) must be separately stockpiled or windrowed from the stockpiles of trucks, limbs, or wood initially. The stockpiles or windrows must be turned at least annually, the time when elevated temperature is observed, or during the periods of raining days to curb odor and maintain required moisture. 34. The maximum dimensions of a windrow are limited to 12 feet in high and 10 feet in base width. A minimum of 25-feet row aisles shall be maintained between windrows. 35. Final product resulting from the passive compost shall only be used as soil amendment or for one of the components of alternative cover material at the landfill facility. OPERATIONAL CONDITIONS – INERT DEBRIS STORAGE AND PROCESSING AREA 36. The area encompassing approximately 0.38 acres and adjacent to the LCIDLF disposal area is approved to processing and treatment of permitted solid waste as defined in N.C.G.S. 130A-294(a)(23) & (24) and shall be operated according to Rule 15A NCAC 13B .0302 and the approved plans. 37. A maximum of 4,000 tons of unprocessed material can be stored this area at any time. A minimum of 50-feet buffer distance shall be established and maintained from drainage features and waste disposal or management units. 39. Inert debris as defined in N.C.G.S 130A-290(a)(14) is permitted to be accepted, collected, temporarily stored, and processed at this area. The accepted inert debris include concrete, brick, concrete block, unterminated soil, gravel, and rock. 40. Upon the sufficient amount of inert debris is stored at the area, the debris will be crushed and processed into aggregated which shall be used for road material at the landfill facility. 41. Pursuant to Rule 15A NCAC 13B .0562(2) and the approved plan (DIN 19483), the permittee shall not conduct any excavation and filling activities at this area. - End of Section- ATTACHMENT 4 CONDITIONS OF PERMIT FOR CLOSURE Not Applicable. - End of Permit Conditions -
