STATUS OF PERMIT:
A Permit to Operate “Municipal Solid Waste Landfill Phases 1,2, and Temporary Cell 1 of Phase 4; Land Clearing
and Inert Debris Landfill” was issued to Ashe County on April 15, 2011. This permit expires on October 14, 2014.

A Permit to Construct “Municipal Solid Waste Landfill Phase 4” was issued to Ashe County on April 15, 2011.

OBSERVED VIOLATIONS:

1. 15A North Carolina Administrative Code 13B .1626(2)(a) states: Except as provided in Sub-Item (b) of this
Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen
material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors,
fires, odors, blowing litter, and scavenging.

Ashe County is in violation of 15A NCAC 13B .1626(2)(a) in that insufficient cover was observed on inactive
portions of Phase 4, Temporary Cell 1 north of the current working face. Waste was also exposed within the
eastern slope of Phase 2 where it meets with Phase 4. To achieve compliance, a minimum of six inches of earthen
material must be provided to all inactive portions of the landfill to include the eastern slope of Phase 2 within 7
days of receipt of the Notice of Violation.

2. 15A North Carolina Administrative Code 13B .1626(11)(c) states: Methods such as fencing and diding shall
be provided within the area to confine solid waste subject to be blown by the wind. At the conclusion of each day
of operation, all windblown material resulting from the operation shall be collected and returned to the area by
the owner or operator.

Ashe County is in violation of 15A NCAC 13B .1626(11)(c) that windblown material was observed east of the
active landfill. This waste was deposited in the subject area prior to the day of the inspection and had not been
returned to the working face at the end of the working day from which it was generated. To achieve compliance,
all windblown waste must be picked up and returned to the working face at the end of the working day.

ADDITIONAL COMMENTS

1. The facility consists of a MSWLF, Land Clearing and Inert Debris Landfill, scrap tire collection area, and white
goods collection area.
2. This was a partial inspection to observe the operations of the facility.
3. The facility is currently accepting approximately 52 tons of Municipal Solid Waste each operating day.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Operations inspection of the MSWLF:

4. Waste was being accepted into Phase 4, Temporary Cell 1.
5. The working face was of manageable size at the time of inspection.
6. No unacceptable waste streams were observed.
7. Edge of liner markers were in place and maintained.
8. The facility is approved for the use of fabric tarps as an alternate daily cover. No tarps were being used with the
landfill at the time of inspection.
9. New wind fence was being placed on the along the eastern perimeter of Phase 4 at the time of inspection.
10. While it is understood that windblown waste will occur, control needs to be proactive instead of reactive. Wind
fence or other preferred device should remain in place at all times. Failure to properly manage windblown
material can lead to risks to birds, deer, and other wildlife. Windblown waste deposited into the drainage swale
located east of Phase 4 would introduce waste into stormwater which would be considered leachate outside of the
liner.
11. All access roads were of all weather construction and maintained.

Operations inspection of the Land Clearing and Inert Debris Landfill:

12. The working face was small and compact at the time of inspection. The area of exposed waste was less than one
acre in size.
13. No unacceptable waste streams were observed.
14. Access roads into the area were of all weather construction and maintained.

Operations inspection of the Tire Collection Area:

15. This area was well managed at the time of inspection. All tires were being stored in a covered trailer.

Operations inspection of the White Goods Area:

16. This area was well managed at the time of inspection. All appliance were stored in an upright manner prior to
removal of chlorofluorocarbons (CFCs). White goods are stored adjacent to the scrap metal pile prior to removal
of CFCs. Removal of CFCs takes place within the recycling building located adjacent to the designated storage
area for white goods.
