Notice of Violation issued February 4, 2016 – RESOLVED –dump receipts emailed 3-21-2016 OBSERVED VIOLATIONS: NONE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On March 16, 2016, Liz Patterson and Drew Hammonds met with Harold Blaylock to conduct a NOV follow-up inspection of the Blaylock Grading LCID Landfill located at 10255 Claude White Road, Harnett County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility has proper signage. 3. The PTO expiration date is July 26, 2018. The permit renewal application due date is December 26, 2017. 4. The facility is properly secured with a locked gate. Personnel are on site during operating hours. 5. The facility is permitted to receive waste generated within Harnett County, Southern Lee County, and Eastern Moore County. 6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. 7. Copy of the facility operations plan and permit were given to Mr. Blaylock to keep on site for site attendant. 8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 9. The working face of the LCID is being kept as small as possible. All areas of waste that are not part of the working face have been covered. Good job! Continue to cover areas that are not part of the working face within 30 days or when the active area reaches one acre in size. Working face All areas of waste outside the working face have been covered The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 10. A ready supply of soil shall be available for cover material. 11. Be sure to grade top of landfill to ensure positive drainage of surface water off the landfill. 12. Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. 13. Maintain a minimum buffer of 50 feet between the pond and disposal areas. 14. Permanent waste boundary markers need to be installed within 30 days and maintained around the entire landfill to include active and inactive areas. Waste marker frequency should be placed so that you can see from one to the other. 15. Property lines must be marked within 30 days to ensure that waste is not being dumped into the 100’ buffer for this facility. 16. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks. 17. Access roads are of all-weather construction. 18. Digital pictures were taken during the inspection. 19. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
