Neither tanks had been permitted to store septage.. This is a violation of Rule .0841 (s) that states “Septage shall not be stored or treated at a new septage treatment or detention facility until a representative of the Division has inspected the facility to determine compliance with these Rules and consistency with the permit application and all permit conditions.” 2) The locations of both tanks were less than the required 50 feet from a property line. This is a violation of Rule .0841(m)(4) that states “Septage detention and treatment facilities shall adhere to the following minimum setback requirements: Property lines – 50 feet.” SEE BACK PAGE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 3) One of the concrete tanks being used to store septage was buried. Buried tanks that are used to store septage shall be certified by a professional engineer to be substantial compliance i.e. leak tested. The use of a buried tank is a violation of Rule .0841(f)(1) that states “Septage detention and treatment facilities located below grade shall: (1) If required by G.S. 89C, a professional engineer shall certify that the construction was completed in substantial compliance with the plans and specifications prior to any waste being introduced into the system.” ADDITIONAL COMMENTS Proper signage Buried septic tank Above ground septic tank Septage in an unpermitted tank SEE ADDITIONAL PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
