Partial Facility Compliance Inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS;
1 – Yard Waste and Yard Trash is now being separated into 2 wind rows.
2 – Minimal residential trash observed. Most of this trash is windblown from the trailer park across the road and some
may have been placed by the public. Staff working on removal.
3 – In would be in the best interest for the Town of Hertford to put up a fence, locked gate/cable and sign to keep the
public out of this site.
4 – During this facility inspection, it was noted that silt from drying beds from the wastewater treatment plant
has been put on this notified site. There is solid waste in these piles. This MUST be removed to a permitted
landfill that can receive this type of solid waste or a permitted land application site for this type of solid waste.
This material does not meet the types of solid waste that can go on this Notified Yard Waste site.
5 – Also during this inspection, it was noted the 200ft. buffer (East side) from the compost areas and homes or
dwellings (trailer park) not owned by the site were not being met. Need to remove and/or push back the waste to
meet this requirement. This distance was checked with a rangefinder and with a 100ft. tape.
6 – It was also noted that the 50ft. buffer was not being met on a property line on the South side of this notified
site. This was checked on Bertie County GIS and observed while on-site. Need to place markers to prevent waste
from encroaching on buffers.
7 – Corrective action needs to be taken due to the results of this inspection. All are mentioned in this report.
