HomeMy WebLinkAbout0702_INSP_20180119FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section UNIT TYPE: Lined MSWLF LCID X YW X Transfer Compost SLAS COUNTY: Beaufort Closed MSWLF X HHW White goods Incin T&P FIRM PERMIT NO.: 0702-MSWLF-1987 CDLF Tire T&P / Collection X Tire Monofill Industrial Landfill DEMO SDTF FILE TYPE: COMPLIANCE Date of Inspection: 19 January 2018 Date of Last Inspection: 19 April 2017 FACILITY NAME AND ADDRESS: Beaufort County Closed MSW Landfill 1342 Hawkins Beach Road Bath, NC 27808 GPS COORDINATES: N: 35.46735 E: -076.85943 FACILITY CONTACT NAME AND PHONE NUMBER: Christina Smith 252.975.0720 FACILITY CONTACT ADDRESS: Beaufort County 111 West 2nd Street Washington, NC 27889 Attn: Solid Waste E-mail: christina.smith@co.beaufort.nc.us PARTICIPANTS: Christina Smith; Beaufort County Public Works Ray Williams; NCDEQ-Solid Waste STATUS OF PERMIT: Closed MSWLF under Subtitle D PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection without records review STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0505 (4)(b) states “Adequate erosion control measures shall be practiced to prevent excessive on-site erosion.” UNRESOLVED: Adequate erosion control measures have not been utilized to prevent excessive on site erosion.” 2) 15A NCAC 13B .0505 (5)(b) states “Surface water shall not be impounded over or in waste.” UNRESOLVED: Ponded surface waters were observed in several areas on the top lift of the landfill. 3) 15A NCAC 13B .0505 (5)(c) states “Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner.” UNRESOLVED: Areas of differential settlement were observed throughout the landfill. These areas lack the necessary slope to promote the positive flow of surface waters from the landfill. 4) 15A NCAC 13B .0505 (6)(a) states “Within six months after final termination of disposal operations at the site or a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses.” UNRESOLVED: Areas a cover crop of native grasses were noted throughout the landfill. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0702_INSP_20180119 Page 2 of 5 5) 15A NCAC 13B .0505 (6) (b) states “Temporary seeding will be utilized as necessary to stabilize the site.” UNRESOLVED: The bare areas have not been seeded to establish a groundcover suitable to prevent erosion of the landfill cap system. 6) 15A NCAC 13B .0505 (7) (c) states “Leachate shall be contained on site or properly treated prior to discharge.” UNRESOLVED: Leachate is seeping from inside the landfill in several areas. No leachate was observed leaving the permitted landfill boundary. 7) 15A NCAC 13B .1107 2 (c) states “The owner or operator of any scrap tire collection site shall control mosquitoes and rodents so as to protect the public health and welfare. Whole and sliced scrap tires, and other scrap tires capable of holding water shall be covered upon receipt with a water shedding material or disposed of, processed or removed from the site within ten days of receipt.” UNRESOLVED: The tire pile in the scrap tire collection area remains uncovered and it does not appear that the tires have been loaded into the trailer in a daily basis. Please see the ADDITIONAL COMMENTS section below for details concerning the violations listed above. ADDITIONAL COMMENTS: 1) This Facility is a closed MSW Landfill, closed Construction & Demolition Debris (C&D) Landfill, Landclearing and Inert Debris (LCID) Landfill Notification, Scrap Tire Collection Site, and a Temporary Disaster Debris Management Site. 2) This site is secured by a chain-link fence with a locked gate at the Facility entrance and has controlled access for security. The Facility access gate was unlocked and open upon my arrival at the Facility and the scalehouse operator was on-site during this Facility Compliance Inspection. 3) The LCID Landfill Notification is currently inactive. 4) The Facility access road is of all-weather construction and is being well maintained at this time. 5) Facility monitoring wells were reviewed. *Please ensure that the area around all monitoring wells is maintained clear of brush and that all wells are properly labelled and secured with functioning locks. 6) All vegetative waste brought on site is staged for grinding at the Yard Waste Notification element, notification #YWN-07-002. *Please see Facility Compliance Inspection Report YWN07002_INSP_20180119. 7) The Scrap Tire Management Area was reviewed. 8) All scrap tires are placed in the concrete bunker lined collection area until placed into the transfer trailer for transport to Central Carolina Tire, permit #43-04 in Cameron, NC for final disposal. 9) The Scrap Tire Management Area is in need of attention. A large number of scrap tires were observed piled uncovered on the ground. *Within thirty days of receipt of this Facility Compliance Inspection Report, please cover with a tarp, or place the scrap tires stored on-site inside the transport trailer. Going forward, all scrap tires collected on-site should be, at a minimum, covered with a tarp or placed into the transport trailer by the end of each workday. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0702_INSP_20180119 Page 3 of 5 10) Additional trailers may be required for the volume of tires managed by this Facility. 11) Overall, the closed areas of the landfill are covered with a well-established cover crop of native warm season grasses. However, several areas were noted as having sparse or no cover. *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair these areas by seeding and mulching to establish a groundcover suitable to prevent erosion of your landfill cap system. 12) Areas of differential settlement were observed in several areas around the landfill. Some of these areas are restricting the positive flow of surface waters from the landfill during and following rain events. *Within thirty days of receipt of this Facility Compliance Inspection Report, please fill and grade these areas to promote positive drainage of all surface waters away from the landfill. All filled areas should be graded at a slope not greater than 3:1 and seeded and mulched to establish a cover crop suitable to prevent erosion of your landfill cap system. 13) Eroded areas were observed on the sideslopes in various places around the landfill. Most of the erosion has FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0702_INSP_20180119 Page 4 of 5 occurred due to a lack of sufficient cover crop. *Within thirty days of receipt of this Facility Compliance Inspection Report, plans need to be underway to repair this area. All repaired areas should be graded at a slope not greater than 3:1, then seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. After the repairs have been completed, please inspect these areas regularly for continued leachate seepage. Any areas of seeping leachate should be repaired immediately to prevent the release of leachate from the landfill. 14) Leachate seepage was observed in several of the eroded areas. No leachate was observed leaving the footprint of the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, plans need to be underway to repair these areas. All repaired areas should be graded at a slope not greater than 3:1, then seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. After the repairs have been completed, please inspect these areas regularly for continued leachate seepage. Any areas of seeping leachate should be repaired immediately to prevent the release of leachate from the landfill. 15) The landfill cap in the immediate vicinity of many of the surface water conveyance devices has eroded. It appears that blockages within the drainage devices and/or equipment damage is causing surface waters to be redirected around the outside of these structures. *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair these eroded areas and remove any blockages that are preventing the proper operation of all surface water drains. 16) Many of the surface water conveyance devices have been damaged by equipment and/or overgrown with brush. *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair these damaged and/or overgrown conveyance devices to ensure the proper operation of all surface water drains and the proper management of all surface waters. 17) A landscaping contract company has been contacted and is working to develop a repair plan and schedule to correct the violations observed during this Facility Compliance Inspection. *The repair project needs to be implemented as soon as possible. 18) *Corrective measures are required as a result of this Facility Compliance Inspection.
