PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements: (2) The facility shall only accept those solid wastes which it is permitted to receive. (3) Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. 15A NCAC 13B .0565 (j) Excavation, grading, and fill material side slopes shall not exceed three to one (3:1). FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 1. There was more than an acre of exposed debris, including the concrete and the side walls. Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. This has been commented on in the past and must be corrected. 2. There were some unacceptable wastes including plastic pipes, plastic bottles, some manufactured wood and railroad ties. When the drivers empty the loads they should be pulling out the unacceptable wastes and disposing of them at a permitted facility. You could keep a container on site for unacceptable materials to be disposed of. The unacceptable wastes at the facility have been commented on in the past. This must be corrected. 3. Insure that solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. This has been stated on several inspection reports in the past. There were hundreds of feet of exposed side walls as well as the debris on top. 4. The side walls ranged from 45 degrees to 90 degrees. ADDITIONAL COMMENTS: 1. 120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. The Division may require further action in order to correct any condition which is or may become injurious to the public health, or a nuisance to the community. 2. Adequate erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent excessive on site erosion. 3. Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. 4. Inert debris may be disposed of within the one hundred foot setback from the property line, only where the submitted plan shows beneficial fill. Clearly visible markers must be placed at the site to show the approved locations of beneficial fill. The areas where beneficial fill can be put in the 100 foot property line buffer were not up at the site. Any beneficial fill going in that 100 foot buffer that is not according to the site map must be removed. 5. The facility is not open to the public. 6. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
