Land Clearing and Inert Debris Landfill Notification approval letter dated April 5, 2013 issued by the SWS to Robert Johnson (cc: Leon Beddingfield). Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN. PURPOSE OF SITE VISIT: Partial inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NONE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS: On October 28, 2015, Mary Whaley received an e mail with a complaint stating that Robert Johnson was accepting C&D waste at his LCID Notified site. Whaley met with Robbie Johnson on October 29, 2015 at the Notified LCID to investigate if C&D was being disposed of at the Double R Farm Land Clearing and Inert Debris Landfill and to inspect the inert material fill activity used as beneficial fill on Hamlin Road in Durham, Durham County. INSPECTION COMMENTS: 1. C&D was not observed at the site. Mr. Johnson stated that the C&D was going to a permitted facility and only the unpainted concrete, block and brick were coming to his site 2. The access roads were very muddy, but it had been raining off and on for weeks. The access roads are to be of all-weather construction. Improvements must be made on the access roads. 3. The working face appeared to be of acceptable size. 4. Pictures were accidently deleted. GENERAL COMMENTS: 1. The facility is a land clearing and inert debris (LCID) landfill. An inert material fill activity used as beneficial fill and a yard waste notification (YWN, 32-005) are also operated on the property. 2. The inert material fill activity abuts the LCID landfill. 3. The LCID landfill, as delineated, is < 2 acres. 4. The LCID landfill contains edge of waste markers - brown wooden poles. 5. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 6. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 7. It is suggested that the working face/area of uncovered material is maintained at half the size as observed during the inspection. 8. Per 15A NCAC 13B .0562 Beneficial Fill, “A permit is not required for beneficial fill activity that meets all of the following conditions: (1) The fill material consists only of inert debris strictly limited to concrete, brick, concrete block, uncontaminated soil, rock, and gravel….” Used asphalt may also be used as fill material. Rebar attached to concrete shall be cut flush. 9. The side slopes of the LCID landfill and inert material fill activity area should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 10. The LCID landfill rear side slope, extending past the edge of waste markers, is stated to be composed only of inert debris. The inert material is covered with soil and graded accordingly. 11. It is suggested that the facility obtain a survey that delineates both the LCID landfill and inert material fill activity area. This survey was not requested at the time of inspection. 12. Logs suitable for firewood may be separated out from material received and stored on the property, removed/cut every few months. 13. The property has a sediment basin. It appeared properly maintained. 14. The site is secured by a locked gate. An operator is on site. 15. The facility has a proper sign. It is recommended that the sign include: “LCID landfill, number N1069.” Please contact me if you have any questions or concerns regarding this inspection report.
