This is an internal courtesy notice to inform your program that the DEQ Brownfields Program has
received a Brownfields Property Application submitted by Dock and 2nd LLC as the Prospective
Developer (PD) seeking entry into the Brownfields Program for the following property:

We are now evaluating Dock and 2nd LLC and the subject property for eligibility for entry into the
Brownfields Program.
The candidate Brownfields Property uses include a hotel with laundry room and maintenance shop,
former dry cleaner that performed clothing dry cleaning, steam cleaning, alterations, and repairs,
hardware store, hotel, school, horse stable, buggy garage, parking, and residential.
Currently, the candidate brownfields property is occupied by the Wilmingtonian and contains three
hotel buildings, paved parking areas, gravel parking areas, and landscaped areas. The prospective
developer plans to remodel and refurbish the hotel and incorporate green infrastructure.
The Brownfields Property Application states that a report regarding the candidate Brownfields
Property was been submitted to the NCDEQ Underground Storage Tank Section and the Inactive
Hazardous Sites Branch on November 29, 2017. The report documents naphthalene and chromium
detected in groundwater at concentrations in exceedance of 15A NCAC 02L .0202 Groundwater
Quality Standards (version April 1, 2013) and volatile organic compounds detected in indoor air
samples.
The Modern Cleaners & Laundry (124 S Front St) and the following underground storage tank (UST)
incidents: 32246, 32213, 22928, 32904, 19128 are located within proximity to the candidate
brownfields property.

Under the Brownfields Property Reuse Act, only entities that did not cause or contribute to the
contamination at the property are eligible to enter the program. The applicant PD listed above have
asserted that: 1) they have not caused or contributed to the contamination at the property, and 2)
they have substantially complied with laws, regulations, and rules for the protection of the
environment. If you have any information to suggest otherwise, please provide that information to
me at samuel.watson@ncdenr.gov by December 21, 2017.
A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or
enforce against any and all parties who caused or contributed to the contamination at the
property. In fact, the BFA will require the developer to provide access to the property to any
party doing work under any DEQ program.
A BFA provides liability protection only to a non-causative redeveloper of the property. The
developer will be required to make the property safe for its intended re-use. Cleanup to
unrestricted use standards will not be required unless deemed necessary based on the
developer's proposed use of the property. Furthermore, the BFA will not change the developer's
responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.)
as required under applicable law.
