Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is a closed, unlined industrial landfill that ceased operations on December 31, 2002. The facility had been used solely to dispose of fly ash from the R. J. Reynolds Tobacco Company’s manufacturing operations. 2. In 2012, the facility received approval for and completed major modifications to the landfill, in an effort to remediate surface water and groundwater contamination. The project included redesign of the fill area to eliminate the large, flat top that had allowed surface water to pond and penetrate the landfill cap and flow through the waste. The new design created slopes that permit surface water to sheet flow off the landfill without coming into contact with waste. In addition, a geosynthetic cap was installed over the entire landfill, which directs surface water to the new drainage system that parallels the toe of the landfill and discharges runoff into three sediment ponds around the perimeter of the facility. 3. Semi-annual groundwater monitoring was verified to be taking place at the facility as required. The two most recent groundwater monitoring reports were reviewed. Both of these sampling events, having occurred March 27 through 29, 2017 and September 6 through 8, 2016, indicated that the concentration of sulfates, metals and total dissolved solids has remained stable or continued to decline since the installation of the geosynthetic cap in 2012. 4. The facility is accessed from a right-of-way easement across an adjoining property that fronts on Edwards Road. 5. The site is secured at the roadway entrance by fencing and a large locking gate that prevents unauthorized access. A second barrier, consisting of a locked cable strung between two bollards, is located just inside the facility property line. In addition, the site is made inaccessible by steeply sloping terrain that surrounds the landfill facility. 6. The access roadway is of all-weather construction and was found to be well-maintained and in good condition. No ponding water or rutting was observed on the roadway. 7. The edge of waste is marked by rebar posts covered with white PVC pipe, and markers were observed to be in place around the entire landfill. Some of the PVC markers are tipped with blue to indicate the location of a drainage outlet pipe. 8. The sediment ponds were observed to be well-maintained with capacity undiminished by the buildup of sediment. Mr. Hopkins explained that the pond located near the southeastern end of the landfill had recently been cleared out, the banks restored and reseeded. He added that he hoped to have grass growing over the berm in the spring. 9. Well-established vegetative cover was observed over the entire landfill cap. The facility appeared to be clean and well-maintained. Mr. Hopkins stated that the slopes are mowed twice annually. 10. Benches are built into the landfill slopes to direct surface water into rip-rapped ditches that convey it to the drainage pipes and sediment ponds. 11. No ponding water was observed and there were no indications of erosion or sedimentation at the facility. 12. No areas of settling were observed at the facility. 13. Drainage ditches and channels were found to be clear and appeared to be functioning properly. 14. Groundwater monitoring wells were inspected and found to be in good condition, with each having a steel casing set in concrete and a legible metal identification tag. 15. Mr. Hopkins stated that R. J. Reynolds Tobacco Company contracts with ERM NC, Inc. to perform quarterly inspections of the facility and to conduct required semi-annual groundwater monitoring. He explained that the quarterly inspections are designed to ensure that the access roads, gates, drain pipes, monitoring wells, perimeter ditches, slope benches, erosion control devices and landfill cap are in good condition and functioning properly; and, to make sure that any maintenance issues are identified and fixed promptly.
