1. On December 6, 2017, The Solid Waste Section received an e-mail from Shelly Stevens, Caldwell County
Planning Director (Director) concerning a complaint received about a dewatering facility that had been
moved to a location near the office of Bumgarner Septic Tank & Grading (Bumgarner). A meeting was held
previously on August 4, 2017 on the property to discuss a proposed septage detention and treatment (SDTF)
facility. At that time, several tanks were present but not hooked up and no septage had been stored.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

According to the Director, a neighbor had called and asked if Bumgarner had gotten permits for the tanks
because he believes he’s doing something along those lines, based on feces and chemical smells coming from
the property.
2. On December 7, 2017, Troy Harrison (the writer) conducted an investigation at the site. The tanks had been
moved from the location observed in August to a site next to the maintenance/storage area at Bumgarners.
No septage was observed in the tanks nor were they hooked up. Other items were stored in a shed.
According to the company, an SDTF permit is not being pursued at this time. No objectionable odors were
observed.
3. No violation of North Carolina Septage Regulations was observed. No further action is required. A Solid
Waste Permit will be required to operate an STDF facility.
