North Carolina General Statute (NCGS) 130A-309.203 Coal Ash Management Act of 2014 requires that the public be given a 60-day period to comment on this draft permit. The comment period will begin Feb. 17, 2016 and end at 5 p.m. on April 17, 2016. Persons wishing to comment on either this permit or the proposed permit conditions should submit their comments in writing to Mr. Edward Mussler, III, P.E., the division contact at the address above, or submit comments by e-mail to publiccomments@ncdenr.gov, please insert the permit number (7906-INDUS-2016) and the permit name (Duke Energy, Dan River Steam Station) in the subject line. The application and draft permit are available for review by appointment from 9 a.m. to 4 p.m., Monday through Friday, at the Department of Environmental Quality, 217 West Jones St., Raleigh, NC 27603. Duke Energy Carolinas, LLC owns and operates the Dan River Steam Station (Facility), electrical power generating facility, located (911 address) at 900 South Edgewood Road, Eden, N.C. and includes a total area of approximately 380 acres. Industrial landfill Permit Number 7906-INDUS-2016 is a new landfill permit that once completed will receive industrial solid wastes from Duke Energy Corporation as noted; coal combustion residuals (CCRs) (including fly and bottom ash, pyrites and coal mill rejects) generated by or at any Duke Energy Corporation facility; wastewater treatment sludge generated at Dan River Steam Station; vacuum truck waste generated at Dan River Steam Station; waste soils (i.e. from ash removal activities or soil that has contacted petroleum); and small quantities of inert debris from CCR unit decommissioning activities. The industrial landfill covers approximately 23.3 acres and will be permitted to include three (3) cells with a total disposal capacity of approximately 2.1 million cubic yards. Duke Energy submitted a new permit application on Aug. 31, 2015. The application requested a permit to construct for Cells 1 through 3 and permit to operate for Cells 1 through 3, as each unit is completed and approved by the Solid Waste Section. The Division of Waste Management has determined that the application satisfied the requirements of North Carolina Administrative Code 15A NCAC 13B .0503 through .0505. A draft permit has been prepared for public review. A public hearing has been scheduled for March 23, 2016 at 6 p.m. and will be held in the Eden Room of the Eden Town Hall, 318 East Stadium Drive, Eden, N.C. 27288. Interested parties may submit oral or written statements and data concerning the proposed facility permit. Persons wishing to speak may register at the hearing. Speaking times will be allotted per speaker as time allows.
