PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. RESOLVED: 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s)
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit.” Permit to Operate No. 2909-LCID-2013, Attachment 3, Conditions of Permit to Operate, Part I, facility
specific condition 8 states, “Excavation, grading and fill material side slopes must not exceed a ratio of three
horizontal feet to one vertical foot (3:1).
The excavation, grading and fill material side slopes had been reshaped completely to a grade less than 3:1. The
landfill slopes had been reduced to an even greater extent than those in the excavation area. Mr. Johnson stated
that he was now able to safely operate heavy equipment on the landfill, and add waste, compact and cover it easily
as it arrived at the facility.

2. RESOLVED: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active
area reaches one acre in size, whichever occurs first.”
At the time of this inspection, all waste in the landfill had been covered, except the newly received brush pile at
the top and toe of the working face. A cover log had been instituted, and indicated that all waste had been
completely covered with clean soil on November 9th and 10th. Mr. Phillips stated that procedure has been to cover
waste as a sufficient amount is received to make it practical. He added that he would again ensure that adequate
cover was applied to all waste in the landfill the first week in December.
3. RESOLVED: 15A NCAC 13B .0566(3) states: “Solid waste shall be restricted to the smallest area feasible and
compacted as densely as practical into cells.”
The entire fill area had been reshaped to enable the compaction of waste as it is placed in the cell. The compacted
waste was observed to be taking up less space in the landfill than during previous inspections.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Mr. Phillips noted that a permit renewal request was in the works and should be submitted to the Solid Waste
Section by December 28, 2017, as required.
2. The facility Permit to Operate and approved Operations Plan were available for review at the site.
3. A cover log had been started after the previous inspection on September 26, 2017, and indicated that the landfill
was last covered on November 10, 2017.
4. The facility was observed to be well maintained and free from windblown litter.
5. The landfill operation appeared to be maintaining the required buffers, with more than 50’ from the waste
boundary to any streams or surface waters and more than 100’ from the waste boundary to any property line.
6. The mixed debris storage area was inspected. Mr. Phillips stated that a clean-up of the area had been completed,
and that he was ready to have the large roll-off container, used to collect litter and unacceptable waste, removed
from the site. He indicated that, with inspections of each incoming load taking place, his customers were being
more careful about the loads they bring to the site and ensuring that they are clean. Thus, he felt the smaller
container would be sufficient to hold the amount of unacceptable materials requiring disposal offsite.
7. Most of the mixed debris stored at the facility had been processed since the previous inspection on September
26, 2017. Mr. Phillips stated that his crushing operation was now able to keep up with the incoming inert debris,
processing it on a regular basis. He added that he was now providing crushing services for other facilities at
their locations.
8. The crushed concrete and stone were graded and separated into product stockpiles by size. The piles were neatly
maintained and of a manageable size.
9. No ponding water was observed in the mixed debris storage area, the debris processing area or the product
stockpile area.
10. The internal access roadways are of all-weather construction and appeared to be well maintained. No ponding
of water or erosion was observed along the roadway, and all areas of the facility were now completely
accessible.
11. The slopes of the landfill had been reshaped to achieve a workable grade less than 3:1. The working face was
observed to be small and well-contained. The entire landfill area was observed to have adequate cover, except
for the newly received brush being disbursed on the working face.
12. Large logs are separated from incoming brush loads and stockpiled near the working face. Logs of a specific
grade are processed with the saw mill to produce rough-cut lumber. The remainder are used in a local program
designed to assist rural residents with household heating during the winter months.
13. No ponding water was observed in the landfill or in the excavation area. Surface water had been successfully
routed to the sediment basin, and Mr. Phillips stated that work on the stormwater control system was still taking
place, but that interim measures had been sufficient to properly direct the surface water and keep it from
ponding and contacting waste. The facility’s erosion control and stormwater system are inspected by DEMLR.
Changes and repairs to the system are taking place to ensure that the facility conforms to its approved erosion
control plan.
14. Proper signage was observed at the facility entrance. Maintenance had been performed along the facility’s road
frontage so that the facility sign was clearly visible.
