OBSERVED VIOLATIONS:
1. Septage Management Rule 15ANCAC 13B .0839(a) “Each permit holder shall maintain a log which includes at
least the following information for each septage pumping event: (1) the date, type, quantity, and location of
septage pumped; (2) location of the discharge of the septage.” (b) “a septage management firm shall make all
records required in accordance with this Section or conditions of the permit available for inspection by a
representative of the Division at the time and place of an inspection of the firm’s septage pumper trucks or upon
request.”
No septage pumping logs are currently being maintained by Forever Clean Portable Toilets Inc. which show the
required information per Rule .0839(a). Gave Mr. Tart an example truck log, reviewed the required
information and discussed that portable toilet waste may be recorded as a daily route for each truck. Begin
maintaining the required information.

The current firm name as listed on the last application & 2017 firm permit is “Forever Clean Portable Toilets,
Inc.” Only one of the vehicles (the new vehicle) had the complete firm name at the required three inch height as
per Rule .0844(b). Instructed Mr. Tart to submit the renewal firm application with the firm name as
“Forever Clean” which would bring all the vehicles’ lettering into compliance. The town name, permit number
& phone number were correct on all six vehicles. Vehicles (tag#CH-2027, and #EY-9563) had damaged decals
which will need replaced in the future.
Outlet covers were on all six vehicles and no drips/leaks were noted. The tanks on all six vehicles appeared
structurally sound & securely attached.
Per Septage Management Rule 15A NCAC 13B .0844(e) “All vehicles used in the transportation of septage,
including spare vehicles and tankers, shall meet the requirements of this section and be included in the permit
application’” Per Mr. Tart these six vehicles are the only pump vehicles in use by this firm at this time.
Instructed Mr. Tart to list all six vehicles on the renewal application for the 2018 firm permit. Contact me
in the future for an inspection if any other vehicles are to be added to the permit.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
