Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility was first inspected September 13, 2017 in response to a complaint about unacceptable material, specifically auto shredder residuals (ASR) being accepted at the facility for disposal. 2. The facility is a notified land clearing and inert debris (LCID) landfill, permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris such as unpainted rock, brick, concrete and concrete block, and used asphalt, in accordance with NCGS 130-294(m). 3. During this follow-up inspection, Mr. Walker used the bucket of a loader to push stockpiled brush out of the way and then to dig several test pits to check for unacceptable material, including ASR. Pits were dug on the south end of the working face and in the area southeast of the facility entrance, where some evidence of ASR had been observed during the September 17, 2017 inspection. None of the pits revealed the presence of ASR or any other unacceptable material. 4. Mr. Walker stated that he had been unaware of any material being accepted at the site other than what he had assumed to be 3 or 4 loads of topsoil, which had been delivered when he was not present. He added that he had indeed used this “topsoil” to cover a portion of the south end of the working face as he graded and stabilized that slope. 5. An attendant must be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes, as required by 15A NCAC 13B .0566(8). The facility was not open for business at the time of this inspection and the access gate was locked, as required. 6. A sign, indicating the contact name and telephone number, must be posted at the facility entrance, as required by 15A NCAC 13B .0566(16). As was the case on September 17, 2017, there was no sign posted at the entry gate. Mr. Strader stated that a sign had been ordered and he expected to have it posted by November 6, 2017. 7. Permanent edge of waste markers must be installed at the facility to ensure that the landfill does not: a. encroach on required buffers (100’ between landfill and property lines and 50’ between landfill and surface waters); b. exceed the designated waste boundaries; or, c. exceed the 2-acre size restriction. Should the landfill exceed 2 acres in size, a full permit must be obtained, as required by 15A NCAC 13B .0563(3)(b). During this inspection, access to areas of the property surrounding the landfill was restricted due to the stockpiling of brush and inert debris along the working face. Therefore, compliance with buffer requirements was not verified. Mr. Strader stated that his consulting engineer hoped to have the edge-of-waste markers in place within the month. 8. The facility shall only accept those solid waste which it is permitted to receive, as required by 15A NCAC 13B .0566(2). Some unacceptable waste, specifically painted concrete, was observed in a pile of inert debris located near the entrance to the facility. This unacceptable waste must be properly disposed of at a solid waste facility permitted to accept such waste. 9. Adequate soil cover shall be applied monthly, or sooner if the active area reaches one acre in size, as required by 15A NCAC 13B .0566(4). Some progress had been made to grade and cover the working face along the northern end of the slope. Mr. Strader stated that he felt he could complete the grading and cover operations for the rest of the landfill within approximately two weeks.
