PURPOSE OF SITE VISIT: Follow-up Inspection STATUS OF PAST NOTED VIOLATIONS: 1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(4) cited for failure to apply adequate soil cover monthly or when active area reaches one acre in size, whichever occurs first. Much of the working face remained uncovered, and the grade of the upper portion of the slope was still almost vertical, although the lower third of the slope had been reduced to a more workable grade. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(3) cited for failing to restrict solid waste to the smallest area feasible. Restriction of waste to the smallest area feasible cannot be achieved until landfill slopes are reduced to a grade that is accessible by the heavy equipment required to compact the waste. RESOLVED: 15A NCAC 13B .0566(2) cited for accepting construction and demolition waste, which it is not permitted to be accepted at the facility. During the June 1, 2017 inspection, a small pile of painted concrete had been observed near the inert debris stockpile. Mr. Westmoreland indicated at that time that the required laboratory analysis for lead had been submitted to the facility prior to accepting the material. A copy of the analysis report, dated May 22, 2017 and stating that lead concentration in the paint sample was less than the 0.010% threshold, was submitted to the Solid Waste Section. No additional unacceptable materials were observed at the site. Therefore, this violation is resolved. SUMMARY OF UNRESOLVED VIOLATIONS AND REQUIRED CORRECTIVE MEASURES To avoid further enforcement action, the following corrective measures are required to be completed on or before November 15, 2017: 1. All waste, including the entire working face of the landfill, must be covered with at least 6” of clean soil and compacted as densely as practical into cells. 2. The working face of the landfill will be regraded to a slope that allows waste to be compacted and soil cover to be applied effectively. Mr. Baker stated his intention to maintain a 4:1 slope on the landfill. 3. Remove any unacceptable waste from the stockpiles and properly dispose of it at a facility that is permitted to accept that waste. 4. Install permanent edge of waste markers that accurately designate the waste disposal boundary of the LCID landfill. 5. Based on current aerial photography of the site (Google Earth – April 2017), it appears that the landfill area may have exceeded 2 acres in size. 15A NCAC 13B .0563(3)(b) states that non-permitted LCID View of the working face from the top edge. Some partial soil cover is visible. Note the near vertical grade of the slope, evidenced by the waste that appears to have rolled down the slope onto the bottom of the fill area below. Demonstrate compliance with this rule by submitting a survey of the facility which delineates the landfill footprint. Please include an area of less than 2 acres that is identified for use as the yard waste storage and processing area. OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. The facility is a notified land clearing and inert debris (LCID) landfill, permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris such as unpainted rock, brick, concrete and concrete block, and used asphalt, in accordance with NCGS 130-294(m). 2. A yard waste notification was received by the Solid Waste Section, reviewed and approved – YWN-34-017. Mr. Westmoreland pointed out the facility’s new grinder and a small stockpile of mulch (processed wood waste) located near the working face of the LCID landfill. Mr. Baker explained that a portion of the wood waste stockpile had already been processed. He noted that some of the mulch had been spread out over the approach to the working face to help with mud. 3. Please note that wood waste operations must be confined to an area of 2 acres or less and must not exceed a volume of 6,000 cu. yds. managed every 3 months. Any exceedance of these limits will require a permit. 4. Mr. Baker reiterated the plan to convert the facility from a landfill into a treatment and processing site for wood waste and concrete crushing. He further explained that, after processing all of the stockpiled material on the site, the intention is to mine the landfill, process all of the recovered materials, and return the area to original grade. 5. Considerable progress had been made in organizing and cleaning up the facility since the previous inspection. The stockpile of inert debris had been reduced substantially and, as a result, the internal roadway system had more maneuvering room for vehicles and equipment to operate safely. Directional signs had been posted to safely manage traffic flow at the site and to assist the public. 6. As waste is received, loads must be inspected and unacceptable waste separated. As processing occurs, any unacceptable waste encountered must be separated. Prior to the end of every working day, all unacceptable waste must be placed in a leak-resistant, covered container or taken to a permitted facility for proper disposal. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Internal access roads with directional signs enable safe traffic flow at the site.
