HomeMy WebLinkAbout20094_Belmont_Dyers_Pub_Mtg_Notice_20171012 PUBLIC NOTICE PUBLIC MEETING FOR BROWNFIELDS SITE FORMER BELMONT DYERS 18 LINESTOWE DRIVE, BELMONT, NORTH CAROLINA This is to provide notice of a public meeting to be held regarding a Brownfields Agreement (Agreement) between Aberfoyle LLC and the N.C. Department of Environmental Quality (DEQ). The draft Agreement is for the former Belmont Dyers property located at 18 Linestowe Drive, Belmont, N.C. The planned Agreement involves Aberfoyle LLC’s purchase of and redevelopment plans for the site. Under the Agreement, Aberfoyle LLC will be subject to land use restrictions in the Agreement designed to make the property suitable for the proposed uses. Aberfoyle LLC is in no way affiliated with Belmont Dyers or any other owner/operators of the former dyeing facility and did not cause or contribute to contamination at the facility. The public meeting will be held from 6-8 p.m. on Oct. 30, 2017, at the City of Belmont Police station, located at 201 Chronicle Street, Belmont, NC 28012. All attendees will have the opportunity to submit written comments, exhibits and/or documents regarding the draft Agreement. DEQ staff will review all comments and take them into account consistent with the Brownfields Property Reuse Act. Time allowing, all attendees will have an opportunity to present oral statements. Time allotted for each oral statement will be based on the number of meeting attendees who desire to speak. Please be advised this public meeting pertains to the proposed draft Agreement and not the local land use or zoning provisions as they relate to the project. The draft Agreement and all other data/documents in DEQ’s possession relevant to it are available on the Division of Waste Management’s website: http://edocs.deq.nc.gov/WasteManagement/Search.aspx. Search using the Brownfields Project ID number 20094-16-036. The same documents are also available for the public’s review at the N.C. Brownfields Program’s headquarters in Raleigh from 9 a.m. to 4 p.m. Monday through Friday. The material includes comments received during the initial 30-day public comment period for the draft Agreement. The comment period ended on Sept. 23, 2017. The materials can be viewed at the N.C. The Brownfields Property was originally developed with a textile mill prior to 1929. The Brownfields Property is 12.88 acres and was formerly occupied by the former dye facility. Former textile operations at the Brownfields Property consisted of yarn mercerizing, bleaching and dyeing. The Brownfields Property was occupied by the Belmont Processing Company until the mid-1940s, at which time Aberfoyle Manufacturing Company (not related to the developer Aberfoyle LLC) took over operations. The Brownfields property was operated by Belmont Dyers Company from the mid-1970s until 2003. The former mill buildings were idle from 2003 until being demolished beginning in mid-2007. The Brownfields Property has remained vacant since that time. The Prospective Developer intends to develop the property for high density residential, open space, parking, recreation, and with prior written DEQ approval, other commercial uses. The Brownfields Property is surrounded by land in residential use. Groundwater, soil and soil vapor are contaminated at the Brownfields Property due to historical activities. The contamination is being assessed and remediated voluntarily by the remediating party under the DEQ’s Inactive Hazardous Sites Program. The subject of this public meeting is the draft Brownfields Agreement between DEQ and Aberfoyle LLC. As emphasized above, the developer who will be subject to this agreement, Aberfoyle LLC, is in no way related to the facility’s former owner/operators and did not cause or contribute to the facility’s contamination. Aberfoyle LLC has proposed redeveloping the property, under land use restrictions proposed in the draft Agreement, to be recorded by Aberfoyle LLC of Charlotte. In accordance with the Agreement, the site’s use will be limited to high density residential, open space, parking, recreation, and with prior written DEQ approval, other commercial uses. Restrictions for the property include stipulations addressing soil, surface water, groundwater, monitoring wells, soil vapor mitigation, and site access for assessment/remediation and annual reporting.
