Partial inspection – complaint investigation.

OBSERVED VIOLATIONS:
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Partial inspection conducted as part of complaint investigation alleging compliance infractions regarding improper
leachate control, lack of cover of waste and slopes.
1. The perimeter of the active MSWLF and closed MSWLF was inspected. There were some areas where it appears
that repairs had been made recently along the toe of the slope on the west and east sides of the landfill. Repaired
areas should be mulched and seeded to establish a vegetative cover to aid in erosion prevention.
2. Leachate was observed leaking from the side slope along the haul road near the working face but terminated within
the landfill footprint just before crossing the haul road. This area needs to be repaired to stop the flow of leachate
before it leaves the landfill footprint.
3. There were areas of exposed waste on top eastern side of the landfill, southwest side slope and an eroded area on the
north west side slope near the toe that need to be covered properly. The sides of the haul road have eroded exposing
waste along the road as well. The owners or operators of all MSWLF units must cover disposed solid waste with
six inches of earthen material at the end of each operating day, or at more frequent intervals as necessary, to control
disease vectors, fires, blowing litter and scavenging.
4. Areas which will not have additional wastes placed on them for 12 months or more, but where final termination of
disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover.
5. There were some bare areas observed during this inspection. Bare areas need to be seeded and mulched to aid in
erosion prevention.
6. Sediment build up was observed in areas of the perimeter ditch with standing water. Ditches should be cleaned out
of vegetation and sediment in order to allow for positive flow of surface water from the landfill. Adequate sediment
control measures (structures or devices), shall be utilized to prevent onsite erosion and silt from leaving the facility.
Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days
or 120 calendar days upon completion of any phase of MSWLF development.
7. There were some trees observed growing over the waste. Trees should be managed as part of the routine mowing
and maintenance of the landfill and should not be growing over waste.
8. The slopes of the landfills are to be maintained at a minimum of 4:l as shown in the operations plan.
9. No photos were taken during this site inspection.
