The application of poultry litter on the permitted fields is a violation of Rule .0838(a)(1) that states “Only domestic septage, as defined in G.S. 130A-290, shall be land applied or otherwise placed on a septage land application site, unless specified in the permit.” Condition 6 of your Permit states that “This site is only permitted for the land application of domestic septage, grease trap pumpings, and portable toilet waste.” Only septage as identified within Rule .0838(a)(1) and Permit Condition 6 should be applied on the permitted fields. SEE BACK PAGE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Poultry litter observed on the field. 1 – Site has proper signage, shares with SDTF-67-16. 2 – Good access road. 3 – Markers are up and appear to be accurate 4 – Septage discharges appear to be within permitted boundaries. 5 – An application of poultry litter was observed on both fields. See Observed Violation and picture above. Chester talked to Haywood on 09/22/2017. Haywood told Chester that the poultry litter was applied to the field by mistake and that he did not want the litter applied to the permitted septage fields. 6 – Crops are present according to the nutrient management plan. 7 – No objectionable odors noted. 8 – Setbacks appear to be in compliance.
