STATUS OF PERMIT: Permit To Operate (PTO) issued December 10, 2015 PTO expiration date October 8, 2020 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On September 26, 2017, John Patrone met with Mark Doggett to conduct a comprehensive inspection of the Heritage Farm Properties LLC LCID Landfill on Scalesville Road in Summerfield, Guilford County. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility is not open to the public. The landfill is used by the Doggett Construction Company, Inc. 3. The facility permit, site plan, and operations plan were discussed. 4. The facility is operating in Phase 1. 5. Ensure Attachment 2 – Conditions of Permit to Construct are met prior to the operation of Phase 2 and Phase 3. 6. The facility is permitted to receive waste generated within Forsyth, Guilford and Rockingham Counties. 7. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 8. Mr. Doggett stated that uncovered land clearing debris (LCD) has been received within the last 30 days. 9. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 10. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 11. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1). 12. A ready supply of soil shall be available for cover material. 13. Permanent edge of waste markers have been installed along the working face area. The area to the right of the active landfill area is dedicated to concrete and gravel storage and the area to the left will be future Phases 2 and 3. 14. The area adjacent to the LCID landfill is used for equipment, supplies, etc. associated with the operation of the Doggett Construction Company. 15. The facility stockpiles concrete to be crushed. Crushed concrete is primary used by the Doggett Construction Company. 16. The facility stockpiles used asphalt to be crushed. Used asphalt is primarily used by the Doggett Construction Company. 17. Per the operations plan, the facility conducts a land clearing debris (LCD) passive compost operation. 18. The facility annual report (FAR) was received by the SWS, dated July 27, 2017. Estimated facility throughput for July 2016 through June 2017 is 27,872 yd3. Contact Christine Ritter, SWS – Permitting Hydrogeologist, at 919- 707-8254 to discuss increasing the facility disposal rate. 19. There was no indication of erosion or runoff. 20. Access roads are of all-weather construction. 21. The facility is secured by a locked gate. 22. The facility has a proper sign. 23. The PTO expiration date is October 8, 2020. 24. The facility permit renewal application shall be submitted to the SWS by June 8, 2020. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
