PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. 15A NCAC 13B .0542 (f)(2); Except as provided in Subparagraph (3) of this Paragraph, areas which will not
have additional wastes placed on them for three months or more, but where final termination of disposal
operations has not occurred, must be covered and stabilized with vegetative ground cover or other
stabilizing material.
Unresolved: The County has made great effort to cover and seed the slopes of the CDLF but, has yet to apply
cover on the eastern slope of the CDLF. All slopes of the landfill shall be covered and stabilized with
vegetative cover.

At the time of this inspection there were several bare areas with exposed waste were observed on the
northern and eastern side slopes of the CDLF. The toe and base of the northern and eastern side slopes were
very saturated. Areas need to be investigated for leachate seeps, covered and seeded.
Waste was also observed protruding from the landfill where heavy equipment is being driven directly up the
slope. The equipment is damaging the landfill cap causing waste to be exposed.
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES
(f) Cover material requirements.
(1) Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units
must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half
acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease
vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement
must be recorded in the operating record as specified in Paragraph (n) of this Rule.
At the time of this inspection the working face of the landfill was estimated, using a range finder, to be about
one acre in size.
2. 15A NCAC 13B .0203 PERMIT APPROVAL OR DENIAL
(d) By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the
conditions of the permit and shall comply with the conditions of the permit.
Per the Approved Corrective Action Plan for the Cumberland County Ann Street Landfill C&D on top of closed MSW the
certified cap of the closed MSW may not be removed.
At the time of this inspection the County was removing soil from the cap of the closed MSW landfill.
ADDITIONAL COMMENTS
1. Waste was observed protruding from side slopes on the north and east side of the active C&D landfill. In
accordance with 15A NCAC 13B .0542 (f)(1) & (2) corrective actions are required.
2. Areas of the CDLF that have been covered since the previous inspection are establishing substantial vegetative
cover.
3. The working face of the landfill must be covered when the disposal area exceeds one-half acre and at least once
weekly.
4. Ensure no water is ponded over waste.
5. Per facility permit to operate, the permittee must properly maintain permanent physical markers that accurately
identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill
facility.
ATTACHMENT 3 CONDITIONS OF PERMIT TO OPERATE, PART I: OPERATING CONDITIONS
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. The permittee must maintain permanent markers that accurately identify the edge of the approved waste
disposal boundary. The boundaries of both the C&DLF unit and the closed MSWLF unit must be marked.
6. The large area of ponded water at the southern toe of the CDLF has been drained and the County is currently
working on construction of the next phase of the landfill. Please, keep an eye on the area to ensure ponding
water does not happen in the future.
7. Under no circumstances may the certified cap be cut back or removed from the top of the closed MSW landfill.

8. Corrective measures are necessary as a result of the inspection findings and should be completed within 30
days’ receipt of this report.
