This is a violation of Rule .0838(a)(7) that states “Septage shall be applied to the surface of the land from a moving vehicle in a such a manner as to have no standing liquid or soil disturbance resulting from the waste flow after the discharge is complete.” Any remaining septage ponding needs to be incorporated into the permitted fields or vacuumed up. 2) Areas of dead vegetation covered in with a coating of grease septage was observed in both ST-1 and ST- 2 application fields. Crop damage that occurs from applications is a violation of Rule .0838(a)(15) that states “Grease septage shall be diluted at least 1:1 from its concentration when pumped with domestic septage or water if land applied over perennial vegetation. This dilution shall be increased if crop damage occurs…” Any remaining septage needs to be incorporated and then a fall cover crop established within 30 days. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 ADDITIONAL COMMENTS 1- Site has proper signage 2- Good access road 3- Markers are up and appear to be accurate 4- Septage discharges appear to be within the permitted boundaries of Fields ST-1 and ST-2 5- Several application issues observed. The ponding of septage in both Fields ST-1 and ST-2 is a violation of Rule .0838(a)(7) stated in Observed violations.
